Alexandre de Moraes and his allies are hinting that they will link @jairbolsonaro’s prison conditions to U.S. foreign policy decisions.

According to Brazilian press reports, Moraes had considered letting him serve his 27-year sentence under house arrest. After U.S. officials warned that the U.S. would have a strong response to his conviction, sources close to Moraes are signaling he will be sent to Papuda — a notoriously violent maximum-security prison — if the U.S. follows through with new sanctions.

Let that sink in. A Brazilian defendant’s treatment is being calibrated not by law or justice, but by the actions of the U.S. government. That is not rule of law. That is hostage diplomacy.

In every normal criminal justice system, punishment is tied to the defendant’s actions, not the political decisions of a foreign government. Adjusting the length, severity, or very nature of a sentence because of what another country does is unthinkable under the rule of law and basic principles of justice.

And this is not a one-off. Moraes has done it before.

• Ordered the detention of Meta’s top executive in Brazil when Facebook didn’t comply with his censorship demands.

• Froze Starlink and X’s bank accounts until they obeyed orders to block users — including those outside Brazil.

• Banned Rumble nationwide for refusing to violate U.S. law and take down lawful speech hosted on American servers.

If you believe in the rule of law, whatever you think of Bolsonaro, this should shock you to the core. A judge that punishes a defendant to send a political message abroad has crossed a line that no free nation should tolerate.
