@jwfamilylaw@FamilyLawHour@hjbrander@jimfitchca@KirstieGibson6 I think the big difficulty is that some forms of NCDR / ADR require a fundamentally different approach to being a lawyer (or judge, for that matter) and so we can’t assume that people can successfully transfer across.

@FamilyLawHour Is Churchill v Merthyr Tydfil going to be the direction of travel for family proceedings? Knowles J said it was unwise to think that decision is of limited relevance to family proceedings.

People have been saying the same in civil for years and a costs order being affected by a refusal to engage in ADR (as it is still there) are still so rare that they still hit the headlines. In 99% of cases the FM5s will just be dead wood!
