The Allahabad High Court has ruled that grabbing a minor girl's breasts and breaking the string of her pyjama do not constitute an attempt to rape, modifying charges in a 2021 case involving a 14-year-old victim.

• Justice Ram Manohar Narayan Mishra delivered the verdict on March 17, 2025, partially allowing a revision petition filed by the accused challenging a lower court's summoning order.

• The court modified charges against two accused, Akash and Pawan, from Section 376 IPC (rape read with Section 18 of the POCSO Act to lesser charges under Section 354(b IPC (assault with intent to disrobe and Sections 9/10 of the POCSO Act (aggravated sexual assault.

• The case stems from a November 2021 incident where the accused allegedly grabbed the victim's breasts, attempted to drag her beneath a culvert, and broke her pyjama string before fleeing when passersby intervened.

• The court stated: "Mere fact that according to prosecution version two accused Pawan and Akash grabbed the breasts of the victim and one of them namely Akash broke the string of her pyjama and tried to drag her beneath the culvert... is not sufficient to hold that a case of Section 376, 511 IPC or Section 376 IPC read with Section 18 of POCSO Act has been made out against the accused persons."

• Justice Mishra distinguished between the "preparation stage" and an "actual attempt" to commit the offense, noting that the prosecution must establish that it had gone beyond the stage of preparation to bring a charge of attempt to rape.

• The court held that while the acts were "serious and shameful", they did not meet the legal threshold for attempted rape, warranting trial under "aggravated sexual assault" instead.

• This ruling has sparked discussions about the interpretation of sexual assault laws and the threshold for attempted rape charges in India.
