Neskantaga First Nation is entirely opposed to Ontario’s recently proposed Bill 5, the “Protect Ontario by Unleashing our Economy Act”. 

Bill 5 attempts to gut basic environmental rights, including our right as Indigenous people to be informed and provide our consent for development on our lands

If Bill 5 passes it will completely cancel the environmental assessment for Wyloo’s Eagle’s Nest mine. This proposed mine sits on the Attawapiskat River, a highly sensitive river system that Neskantaga has had a sacred duty to protect and steward since time immemorial. 

Bill 5 will make “special economic zones” where mining proponents will be totally exempt from certain provincial laws and protections. “Trusted proponents” will have their projects “pre-approved” by the government, allowing them to destroy our homelands without our consent. 

Ontario claims it will “continue to honour its Duty of Consult for all projects”. However they are abolishing environmental assessment in the region, which is the main channel for Indigenous consultation. The government is not offering any suggestions of what will take its place. 

Bill 5 repeals the Endangered Species Act and replaces it with the Species Conservation Act. This makes species protection an optional initiative to be something that mining companies can choose to take on voluntarily rather than making these essential protections mandatory (as they are now). 

Ford’s “special economic zones” are just “constitution free zones”. They create an environment where the duty to consult doesn’t apply. Exempting the Ring of Fire from impact assessment makes it optional for mining companies to respect our inherent Treaty & constitutional rights
