Dear Justices Tsammani, Stephen Adah, Misturat Bolaji-Yusuf, Boloukuoromo Moses Ugo and Abba Bello Mohammed,
Whether you realise it or not, today, literally and figuratively, you stand at the helm of the ship of the state called Nigeria. This ship is in choppy waters, with rocks up ahead, and the safety of calmer on a different trajectory.
This is the most important day in your lives, the day when you finally define who you really are, to the world, and most importantly, to yourselves and your descendants forever.
You get to choose who directs the affairs of 200m of the poorest people in the world today. I am aware of the pressure you are under, both from the sheer weight of the responsibility you bear, and the expectations of our beleaguered people AND our oppressors alike.
However, you have a duty to focus STRICTLY on The Law. What does the law say about these issues:
1. A person who, wanting to contest elections, submits fake documents to INEC to further his aspiration
2. What laws, regulations and guidelines INEC is meant to follow, and what happens if they fail to follow them.
3. The significance of winning 25% of the valid votes cast in the Federal Capital Territory in a Presidential Election. What happens if a candidate fails to win 25% of the votes cast in the FCT?
4. When a candidate presents EVIDENCE that is not controverted, by way of result sheets duly signed and certified by INEC, which show that he in fact had the highest number of valid votes, in the country, and also had 25% of the valid votes cast in 24 of the states AND the Federal Capital Territory.
There are other issues for you to determine, but these, to my mind, are the main issues.
If you fail to deliver a judgement that falls short of constitutional provisions on the above issues, you will become responsible for the chaos that is almost certain to follow.
Following the various insurrections accross Africa, most of which, as correctly observed by President Obasanjo, arose directly from the abuse of democratic processes by politicians, the responsibility you bear is now even more grave and significant.
Nigeria is now in your hands. Fail, and you will bear the consequences unto your generations. Succeed, and you will be celebrated for generations to come. The choice is yours.
