Kansas already ran this exact experiment, and the record is not close. The state's proof of citizenship law blocked 31,089 eligible registrations, a tenth circuit appellate court's own precise number, 12 percent of everyone trying to register for the first time. In exchange for that, the state's own evidence in court identified 39 noncitizens who managed to register over nineteen years, an average of about two a year, which the appeals court itself called incredibly slight evidence. A federal judge eventually struck the law down entirely and ordered Kris Kobach back to legal education classes before renewing his own law license.

The SAVE America Act's polling numbers tell a similar story once you ask the actual question instead of the easy one. Voter ID alone polls at 74 percent. Ask about the documentary proof of citizenship requirement specifically, and support drops to somewhere between 51 and 65 percent depending on the poll. Ask whether people support the SAVE Act as a whole, the actual bill with its mail voting ban and its federal takeover of state election administration, and it falls to 37 percent, with 63 percent either opposed or unsure. That gap between how a slogan polls and how the actual legislation polls is not an accident. It is the entire strategy.

Worth sitting with the passport numbers too. A hundred forty million Americans do not have one. Twenty-one million voting age citizens have no citizenship document handy at all. Only five states even issue the enhanced REAL ID that shows citizenship status, and more than a third of Americans mistakenly believe their standard REAL ID already does. The gap between what people think they can produce and what they can actually produce is exactly where Kansas lost thirty-one thousand real, eligible, documented citizens the first time this idea got tried at scale.

A few notes on the Comey indictment:

1) Yes, Trump and lots of allies were indicted, too. They were overwhelmingly convicted by juries when the cases actually went to trial. We’ll see whether Comey is, too.

2) There is no comparison between Biden’s role in those prosecutions and Trump’s role in this one. Trump’s charges were brought by a special counsel, not a Biden-appointed US attorney or even AG Garland. These ones were brought by a Trump loyalist who was installed shortly after Trump forced out a US attorney who declined to charge, and shortly after Trump publicly called for the prosecution. There is no evidence that Biden applied such pressure on DOJ, though he on a number of occasions violated DOJ norms by commenting on investigations (https://t.co/cFvcSsJyLS). Biden repeatedly said he wasn’t getting involved and emphasized DOJ independence in such matters – a major contrast to Trump publicly calling for prosecutions of Comey, James, Schiff, Soros, etc., and criticizing those who didn’t bring charges (including his own AG).

3) The Comey situation is also unlike these other federal cases in that not only did the US attorney decline to bring charges, but the DOJ inspector general investigated the matter and reached similar conclusions. He cited “considerable circumstantial evidence” and “concluded that the overwhelming weight of that evidence supported Comey’s version of the conversation.” Maybe there is better evidence now, but two investigators who looked at this didn't seem to think it rose to the level. Now it's being charged on the eve of a deadline after an extraordinary series of events.

4) Whatever you think of how advised it was to indict a former president, these were things even Republicans said were very bad. Seven GOP senators voted to convict Trump at his Jan. 6 impeachment trial – a historically bipartisan vote. And on Trump's classified documents indictment, Trump’s own former AG, Bill Barr, said the evidence looked damning and that Trump’s defenses didn’t hold water.
