Yesterday beehiiv announced its new community product. A no-brainer addition to the roadmap to take on Circle.
Today it quietly announced something more important. Its new Terms of Service.
Beehiiv has always positioned itself as infrastructure. Substack is the platform. The distinction was simple. Substack wants readers to live inside Substack. Beehiiv gives publishers the tools to build their own audience, their own brand, their own business.
The new terms make that distinction a lot less clean.
Beehiiv can now use subscriber behavior across publications, enrich that data with demographic info, and use those profiles to improve its ad network and future data products.
They emphasize they'll never share personal subscriber info with advertisers. That sounds meaningful. It isn't, really. Advertisers don't need your name or your email.
Imagine beehiiv knows someone subscribes to three personal finance newsletters, clicks on mortgage rate articles constantly, lives in Texas, and is probably in their thirties.
They don't need to tell an advertiser who that person is. They just say: "We can reach 40,000 people who look like they're prepping to buy a home."
Or they flag readers who follow travel newsletters, engage with credit card content, and skew high income. No name required. Just the right ad in front of the right person.
That's what enrichment buys you.
None of this is scandalous. It's exactly what Google did. What Facebook did. What every great advertising company eventually does. And in just about every case, media companies ended up on the losing end of it. Algorithm swings, shrinking CPMs, and a platform that just built a better ad product than anyone else could.
I'm an early believer in Tyler and small investor in beehiiv and love what they have done for the industry. From that view, this is smart. Plus, Circle probably has as much or more revenue as beehiiv, so winning that market share is a no-brainer.
But if you're a media company or publisher building on beehiiv, it's worth asking yourself the question directly: is this actually infrastructure, or is it pipes feeding the platform? In 5 years, will beehiiv have such strong data and an ad product they stop selling infrastructure?
That sounds like Substack.
My read is that beehiiv has decided their core ICP is large independent creators. People like Colin and Samir. That group doesn't care nearly as much about data usage and don't have ad sales teams like enterprise media companies do. So this move probably doesn't touch the big creators much, and could genuinely help them make more money via ads. It probably weakens the pitch for the bigger media companies to move over.
All this is speculation of my own experiences. Either way, they did have a shift in their ToS and paints a picture of where beehiiv is headed, an advertising company.
