The Supreme Court of Pakistan has charged the PTI of violating its constitution and democratic norms. Before literally announcing the annihilation of the PTI in its judgment in election symbol case, Saturday, had the Supreme Court of Pakistan consistently demonstrated the same vigor, determination, and commitment to defending the constitution, democracy, and the rule of law in Pakistan, our motherland today would've been a proud, robust, vibrant democracy. Elections would have been free and fair, but, unfortunately, no elections ever offered a level playing field for all political parties. Each election witnessed the Election Commission of Pakistan and other state institutions siding with the favored political party of the day while actively crushing its most popular opponent. The Election in 2024 on February 8 will be no different.

Echoing the same theme Dawn newspaper editorial has made important observations: " Just days after it overturned a past Supreme Court ruling on lifetime disqualification under Article 62(1)(f) on the grounds that the bench that previously decided the matter had ‘read into the Constitution�� to conjure up a punishment that never existed, a three-member bench of the apex court under the incumbent chief justice seemingly endorsed a very similar transgression by the ECP."
The Dawn editorial went on to observe " Given the implications of the punishment imposed on the PTI, that too mere weeks before a general election is due to take place, most legal observers following the proceedings in the Supreme Court had agreed that for the top court to endorse the ECP decision would be tantamount to denying the public their constitutional right to vote for the parties and political leaders of their choice."

یہ چیف جسٹس کی کرسی میں ایسا کیا ہے کہ اس پر بیٹھا شخص ایک جرنیل کی سازش ناکام بناُکر دوسرے جرنیل ��ی گود میں بیٹھ کر کلکاریاں مار کر خوش ہوتا ہے۔ افتخار محمد چودھری نے جنرل مشرف کیطرف سے اپنی برطرفی کا بدلہ جنرل کیانی کی گود میں بیٹھ کر لیا، اور آئین اور سیاست کو رسوا کرنے والے ساتھی جج جسٹس عبدالحمید ڈوگر کو بجا طور پر ذلیل و رسوا کیا مگر ساتھ میں جنرل کیانی کو مضبوط بنانے کے لئیے آصف زرداری کی حکومت اور سیاست دانوں کو سو موٹو اختیارات ذلیل کرنے میں کوئی کسر نہیں چھوڑی۔ آصف زرداری کا قصور افتخار چودھری کی فوری بحالی کی مخالفت تھی، جنرل کیانی اور بحال شدہ افتخار چودھری نے پھر مل کر سیاستدانوں اور سویلین حکومت کرپشن کے الزامات پر یرغمال بنا کر رکھا-

آج بھی وہی کچھ ہو رہا ہے، اس میں کوئی شک نہیں کہ جنرل باجوہ، جنرل فیض اور عمران خان کی مخلوط حکومت نے جسٹس فائز عیسی کو ذاتی طور پراور اِس ملک کے سیاسی اور عدالتی نظام کو نا قابلِ تلافی نقصان پہنچایا جس میں ثاقب نثار، آصف سعید خان کھوسہ اور بندیال ٹائپ ججوں کا گھناؤنا کردار رہا ہے مگر اب چیف جسٹس فائز عیسی کیا کر رہے ہیں؟ افتخار ��ودھری کی طرح معجزاتی بحالی کے بعد چیف جسٹس فائز عیسی کو بھی جسٹس اعجاز الاحسن کا سر طشتری میں پیش کیا گیا ہے بلکل اُسی طرح جس طرح جسٹس عبدالحمید ڈوگر اور ساتھی پی سی او ججز کو افتخار چودھری کی رحم و کرم پر چھوڑ دیا گیا تھا۔ ویسے تو ایسے استعمال شدہ ججوں کیساتھ جتنا بھی ہوا وہ بہت کم تھا مگر پھر یہ ہر بحال شدہ چیف جسٹس ہر نئی اسٹیبلشمنٹ کی خوشنودی کے لئیے سیاستدانوں اور سیاسی جماعتوں کو کمزور کرنا اپنا مذھبی فریضہ کیوں سمجھتا ہے، بحال شدہ افتخار محمد چودھری نے ایک لومڑی کی مانند اسٹیبلشمنٹ کے بوڑھے شیر کے غار تک آصف زرداری اور سویلین حکومت کو گھیر کر لایا، بلکل اِسی طرح بحال شدہ قاضی فائز عیسی بھی جسٹس اعجاز الاحسن کے سر کو اسٹیبلشمنٹ کا تحفہ سمجھ کر اب عمران خان، اُسکی سیاسی جماعت اور ملک کی سیاسی جماعتوں کے اندر بھی انجینئیرنگ کی راہ ہموار کر رہے ہیں۔ افتخار چودھری کو بھی اپنی شھ��ت اور عوامی مقبولیت پر ضرورت سے زیادہ اعتماد تھا جسکا نتیجہ اسکے بیٹے ارسلان کے کارناموں کیصورت سامنے آیا اور قاضی فائز عیسی بھی اُسی راستے پر چل نکلے ہیں۔
بلے کے نشان متعلق چیف جسٹس قاضی فائز عیسی کا فیصلہ ایک طرف عمران خان اور پی ٹی آئی کے اُس گھناؤنے پراپیگنڈا کا براہ راست جواب ہے جو انکی حکومت میں صدارتی ریفرنس کے دوران کیا گیا۔ تو دوسری طرف ایک بڑی سیاسی جماعت کو انتخابی عمل سے باہر رکھنے کی سازش کا حصہ بھی ہے۔ ایک تیر سے دو شکار ہو گئے ہیں، عمران خان اور اُسکی پارٹی کے ساتھ جو ہوا وہ انکا اپنا کیا دھرا ضرور تھا مگر بطور سپریم کورٹ اور بطورچیف جسٹس قاضی فائز عیسی نے جس طریقے سے بلے کے نشان متعلق کیس کی سماعت کی اور دنیا نے براہ راست دیکھا وہ کسی طور بھی ذاتی رنجش اور انتقامی جذبے سے مبرا نہیں تھا۔ آج کا جنرل کیانی اور افتخار چودھری ایک بار پھر آج کے زرداری کے در پر ہیں۔

بلے کے نشان متعلق سماعت میں قاضی فائز عیسی نے ایک جج کی بجائے الیکشن کمیشن کے وکیل کا کردار ادا کیا، آئینِ پاکستان کے دفاع کا حلف اُٹھانے والے سپریم کورٹ کے تین ججوں نے ایک سیاسی جماعت (پی ٹی آئی) کے آئین پر عملدرآمد میں جتنی دلچسپی دکھائی اُس سے واضح طور پر انتقام اور ذاتی رنجش کی بو آ رہی تھی، یہ وہی چیف جسٹس تھے جو ایف بی آر اور دیگر قوانین کی خلاف ورزی کے دفاع میں بجا طور پر آئینِ پاکستان کی شق ۲۰۹ اور عدلیہ کی آزادی کی قوالی کرتے نہیں تھکتے تھے، اور اب جب مخالفین کا کیس سامنے آیا تو الیکشن ایکٹ عیسی کی بائیبل بن گیا۔
آئین کی تشریح پر انا کی تسکین حاوی ہو گئی، اعجاز الحسن کا استعفی، چند لاپتہ افراد کا واپس آ جانا، سیکرٹری دفاع کا افواج پاکستان کا افواج پاکستان کو خ، اس سب سے انا کی تسکین تو ہو جائیگی آئین کی تشریح نہیں۔
آئین کی شق ۱۷ میں تنظیم سازی کا بنیادی حق عام شھری کا ہے مگر جج صاحب کے لئیے اکبر ایس بابر کا پی ٹی آئی کا بانی رکن ہونا قاضی صاحب کے لئیے مقدس واقعہ ٹھرا۔ سیاسی جماعت کے آئین اور الیکشن ایکٹ کی خلاف ورزی تو شاید پی ٹی آئی نے ہی کر رکھی تھی کیونکہ کسی اور پارٹی کے کارکن نے شکایت ہی نہیں کی تھی ، واہ قا��ی تیرا انصاف، آئین کے آرٹیکل ۲۰۱۸ (صاف شفاف انتخابات)پر الیکشن ایکٹ حاوی ہو گی۔ یہ سب عدالتی انجینئیرنگ نہیں تو کیا ہے۔ قاضی فائز عیسی کا یہ نیا رخ (شاید پرانا) کیا گل کھلائے گا؟ یہ چیف جسٹس کی کرسی میں ایسا کیا چُبھتا ہے جو اُسے اسٹیبلشمنٹ کے بوٹ میں اپنی شکل تلاش کرتے رہنے پر مجبور کرتا رہتا ہے، ظالمو قاضی ہمارے ہاتھ سے جا رہا ہے۔ہ

The Human Rights Council of Pakistan has expressed serious concern over the decision of the Supreme Court. A few days before the general elections, a major political party (Pakistan Tehreek-e-Insaf) has been deprived of its electoral symbol. Taking away the electoral symbol from a political party will adversely affect the voters of that party. Due to this decision of the Supreme Court, political instability will increase in Pakistan. Excluding a major political party from elections on technical grounds will destabilize democracy. With this decision, the transparency of the general elections 2024 is likely to become more controversial. If the elections are not transparent, deep questions will arise on the transparency of the elections at the national and international level. The Human Rights Council of Pakistan believes that political and economic stability can be brought to the country only if basic rights are protected in Pakistan.

#Pakistan 🇵🇰: The International Human Rights Foundation expresses deep concern over the recent decision, taken at midnight, to strip the most popular political party, PTI of its election symbol, thereby rendering the party without direction. This action speaks volumes about the apparent state-sponsored fascism and political engineering in Pakistan, orchestrated by the establishment operating under the military junta.

It is aptly being characterized as a "huge blow to fundamental rights," reflecting a disturbing trend in the erosion of democratic principles. This decision, akin to the regrettable events of 1971 when similar circumstances led to the disintegration of Pakistan and the creation of Bangladesh, will be remembered as a shameful and biased moment in history.

The International Human Rights Foundation urgently calls upon global bodies to intervene in Pakistan to stabilize the situation, which is rapidly escalating towards a humanitarian crisis. This is especially alarming in a nuclear-armed Republic with a population of 250 million people. The world can not afford to ignore such a precarious situation, and immediate action is imperative to safeguard fundamental rights and prevent further deterioration.

I was deeply disappointed yesterday, when the Senate majority rejected this Resolution urging the Government of Pakistan to develop food systems-related institutional mechanisms in line with Pakistan’s global commitments ahead of COP-28.  
On the one hand, climate change, Pakistan’s burgeoning population, the precarious water scarcity situation and the tendency to use arable land for lucrative housing schemes is creating serious food security challenges, and is threatening the future of generations, but on the other hand, our
toxic political environment is not just hampering the country’s progress on such existential matters, it is also undermining Pakistan’s  reputation globally.
