So let me get this straight. Government lawyers lie to the Court to gain an unfair advantage in litigation and the SEC’s answer is to say that going forward those lawyers will now be taught to be honest when saying things to Judges. Gensler’s SEC has become a travesty.

They slowed down the momentum of @Ripple just like they were instructed to do. They took it as far as they could and now they’ll turn around to the same people who ordered them to bring the case against #ripple in the 1st place and say, “we bought you all the time we could”. You’re on your own. Case will quietly settle or be dropped. You’ll never hear about it again and the SEC will attack the next competitor on their bosses list.

"What is the difference between those that are not [securities] and those that are? And how has that been communicated by the SEC to the investing public and to those involved in the space so that they know that this type of asset may implicate the securities laws and some other cryptoasset may not?"
The SEC lawyer answers (paraphrasing)--all they need to do Judge is read the 1946 Howey case about the orange groves.
Obviously unpersuaded by the absurd answer, the Judge tries again:
"I am just trying to figure out how folks involved in the industry can know that a particular crytoasset with which they are involved is or is not going to be found at some later date by the SEC to be a security."
Exactly.

He tried to create a monopoly that JP Morgan, Consensys, the EEA, Jay Clayton, Simpson Thatcher, Bill Hinman, A16Z, and all the ETH whales would benefit from. They all acted unethically, and some even acted illegally. It's no wonder the DOJ tried to get @StevenNerayoff to give up the goods on @ethereumJoseph, and who's to say he didn't? The case against Steven was mysteriously dropped after he had already been indicted. If I were Lubin or Vitalik, I'd be running back to Sweden. Oh, wait, that's right, they can't because they screwed over 35 employees by secretly selling core parts of the Ethereum business to JP Morgan and are now being sued in Swiss Court. Or at least Joseph is. Everywhere they go, everything they touch, turns to s***.
Omg the Promethean backers were involved in not one but two other crypto related scams previously, and yet the SEC approved them over Coinbase, Kraken and others?!
