سدیس ویلاز میں پلاٹوں کے تنازعے نے سنگین صورتحال اختیار کر لی، متاثرین کا قانونی کارروائی کا فیصلہ

پشاور کے ورسک روڈ پر واقع سدیس ویلاز ہاؤسنگ سوسائٹی میں پلاٹوں کی ملکیت کا تنازع شدت اختیار کر گیا ہے، جہاں درجنوں متاثرین نے مبینہ قبضے اور غیر قانونی تعمیرات کے خلاف عدالت سے رجوع کر لیا ہے۔ متاثرین کے مطابق انہوں نے سوسائٹی میں مکمل قانونی تقاضے پورے کرتے ہوئے پلاٹ خریدے، جن کے تمام ادائیگی ریکارڈ، رسیدیں اور الاٹمنٹ لیٹرز ان کے پاس موجود ہیں۔

ذرائع کے مطابق سدیس ویلاز ابتدائی طور پر تین شراکت داروں کی ملکیت تھی، تاہم ایک پارٹنر کے انتقال کے بعد باقی شراکت داروں کے درمیان اختلافات پیدا ہوگئے۔ متاثرین کا الزام ہے کہ ایک شراکت دار افتخار نے پہلے سے فروخت شدہ پلاٹوں پر دوبارہ ملکیت کے دعوے شروع کر دیے ہیں، جس کے خلاف تقریباً 40 سے 50 متاثرین متحد ہو کر قانونی جنگ لڑ رہے ہیں۔ متاثرین نے سوسائٹی کی نئی انتظامیہ کے خلاف بھی کارروائی شروع کی ہے، جبکہ ان کا مؤقف ہے کہ انتظامیہ نے تنازعے سے لاتعلقی اختیار کرتے ہوئے معاملہ متاثرین پر چھوڑ دیا ہے۔

متاثرین کے مطابق عدالت کے حکمِ امتناعی کے باوجود متنازع پلاٹوں پر تعمیراتی سرگرمیاں جاری ہیں اور بعض مقامات پر بھاری مشینری کے ذریعے زمین کی ساخت تبدیل کی گئی ہے۔ متاثرین نے پولیس کے مبینہ غیر مؤثر کردار پر تشویش کا اظہار کرتے ہوئے سی سی پی او پشاور سے فوری نوٹس لینے اور عدالتی احکامات پر عملدرآمد یقینی بنانے کا مطالبہ کیا ہے۔ متاثرین کا کہنا ہے کہ وہ اپنے قانونی حقوق کے تحفظ کے لیے ہر فورم پر جدوجہد جاری رکھیں گے۔

Sudais Villas, a housing society on Warsak Road, has become a matter of serious concern for dozens of affectees. My cousin invested there and purchased two plots with complete legal documentation, including all payment receipts and allotment letters.

The society was originally owned by three partners. After the death of one partner, disputes emerged between the remaining two. One of them, Iftikhar, who is reportedly influential and backed by political figures, has now started claiming ownership of plots that were already sold to buyers. Around 40–50 affectees united against him and filed a case, along with legal action against the new management of Sudais Villas, which distanced itself from resolving the matter and asked owners to settle the dispute themselves. The suspicion among affectees is that this is a coordinated attempt to take back prime plots at the entrance of the society for future commercialization.

Despite a court stay order against him, Iftikhar has continued construction on my cousin’s plot and even used tractors on other lands to alter and pave the area. Today, we will again approach the police station, but the response so far has been disappointingly slow. We expect the CCPO to take notice and ensure the law is enforced.

Important advice for anyone investing in a society: Always secure and preserve every payment receipt, file, and especially the allotment letter, as it serves as critical proof of ownership. Alhamdulillah, we have all the required documents and will continue our legal fight against the qabza mafia.
