यह पिछले 12 वर्षों के इतिहास में किसी भी न्यायालय द्वारा दिया गया अकेला न्याय है जिसमें संविधान, देश और आम आदमी के मौलिक अधिकारों की विजय हुई है। यह बॉम्बे हाईकोर्ट के जस्टिस माधव जामदार हैं। इस विद्वान न्यायाधीश ने अपने एक फैसले में जो कहा है वो नजीर है, नजीर रहेगीं। इनका फैसला बीजेपी और मोदी एवं शाह की आँखों के किरचों की तरह चुभेगी।

दरअसल सोशलिस्ट डेमोक्रेटिक पार्टी ऑफ इंडिया (SDPI) के महासचिव सईद अहमद अब्दुल वहीद चौधरी के खिलाफ एक साल के लिए जिला बदर आदेश पारित किया था। सईद केंद्र सरकार के विभिन्न फैसलों जैसे नागरिकता संशोधन कानून (CAA) और ज्ञानवापी मस्जिद विवाद के खिलाफ मोर्चे और धरने आयोजित कर रहे थे

जस्टिस जामदार इस आदेश पर आगबबूला हो गए। उन्होंने कहा "यह क्या है? सभी नागरिकों को भारतीय सरकार का गुलाम बनाया जा रहा है। वे प्रदर्शन नहीं कर सकते, आंदोलन नहीं कर सकते ।यह सब क्या है? अब इतने सारे पेपर लीक हो रहे हैं। अगर लोग विरोध करें तो आप केस थोप देंगे। यह क्या है? नागरिकों का प्रदर्शन करना उनका अधिकार है।

याचिकाकर्ता ने तो सिर्फ 'बीजेपी सरकार मुर्दाबाद', 'अमित शाह मुर्दाबाद' जैसे नारे लगाए.।नागरिक ऐसे नारे क्यों नहीं लगा सकते? ऐसे नारों के लिए जिला बदर आदेश क्यों?"

जस्टिस जामदार ने आगे मौखिक रूप से टिप्पणी की कि पुलिस नागरिकों को सिर्फ इसलिए बाहर नहीं कर सकती क्योंकि उन्होंने सरकार के फैसलों का विरोध किया है।"पुलिस मुख्यमंत्री या प्रधानमंत्री की सेवक नहीं है, वे जनसेवक हैं। मैं आपके अधिकारियों पर भारी जुर्माना लगाऊंगा।"

जस्टिस जामदार ने महाराष्ट्र की राजनीति में चल रहे "हॉर्स ट्रेडिंग" पर भी टिप्पणी की। उन्होंने कहा "कल परसों एक 10 साल के बच्चे की दुर्घटना में मौत हो गई और राज्य विधानसभा में क्या चर्चा हो रही थी कि प्रेसिडिंग ऑफिसर कैसे चुना जाए और वह एक पार्टी से दूसरी पार्टी में कैसे शिफ्ट हो गया।यह क्या है? वैसे भी पूरे महाराष्ट्र में हॉर्स ट्रेडिंग चल रही है। आपके पास कुछ FIRs हैं।केस बदलने पर विचार करें, वॉशिंग मशीन है।" और सईद अहमद का जिला बदर रद्द कर दिया गया।

So will the Kangaroo courts in West Bengal correct the historical wrongs? From one of the most prosperous states WB went down on all parameters. The slide occurred thru the congress, CPM and the TMC from the economy to law and order. Cadres unleashed violence on streets.
BJP won a historical victory to get an opportunity to correct the wrongs and look at - education, health, investment, jobs, infra and economy in general. Is revenge and that also on the streets against then TMC MPs, leaders and cadres, the way to go? What will the world say about the @DGPWestBengal with @MahuaMoitra appealing for control of a mob throwing eggs and stones at her and the building she was in? So is it the reply to Rajeev Kumar ex DGP now TMC MP. More than the politicians, it is these shameless and bootlicking babus & policemen (Read IAS & IPS) who have destroyed the name of IPS and police and the bureaucracy.
We will look like a banana republic, unless @narendramodi reins in these street mobs thru the "more holy than thou" @SuvenduWB

Sharp Edge : The ongoing controversy over Indian citizenship has combined with the dubious SIR exercise to deny Indians their
rights. A passport is not proof of citizenship we are told. And anyway if they strike you off the electoral rolls because of SIR you can’t even renew your passport

The recent statement by the Ministry of External Affairs (MEA) - - on #PassportSevaDivas, no less! - - clarifying that an Indian passport is primarily a "travel document and not conclusive proof of citizenship" has triggered a predictable wave of public bewilderment and political sparring. 

While the government defends this as a long-standing legal position rooted in Section 20 of the Passports Act of 1967 (which technically allows the state to issue passports to non-citizens under rare, public-interest circumstances) this is a distinction without a difference, meaningless to the average citizen.

For decades, the passport has been considered the gold standard of identity. We navigate the gruelling bureaucratic maze of police verifications and document checks required to obtain one, precisely because the state demands concrete proof of citizenship before granting it. To turn around and declare that the very document born from this rigorous vetting does not actually prove citizenship creates an absurd legal paradox. If a passport does not establish domestic citizenship, then what does?

The Supreme Court has already ruled that the Aadhaar card is merely a proof of identity and residence, not citizenship. This leaves millions of Indians in a bizarre administrative limbo where they possess world-class biometric and state-issued documents, yet none are legally deemed "conclusive" proof of their nationality within their own borders. 

To end this fatuous controversy once and for all, a common-sense legislative overhaul is urgently required. The government should formally amend the legal framework to make both the passport and the Aadhaar card valid, conclusive proofs of Indian citizenship unless they are explicitly cancelled or withdrawn by the state.

Implementing this requires solving a critical administrative hurdle: because Aadhaar is currently issued based on 182 days of local residence rather than nationality, it is held by citizens and non-citizen residents alike. The solution is straightforward. The Unique Identification Authority of India (UIDAI) should introduce a visually distinct Aadhaar card (featuring, say, a visible diagonal red stripe across the front), specifically designated for non-citizens living in India.

By clearly demarcating the two categories, the state can safely mandate that carrying either a standard citizen's Aadhaar or a valid passport is compulsory and sufficient proof of citizenship for all Indian nationals at all times. This dual-document policy would immediately streamline domestic verification, eliminate arbitrary bureaucratic challenges during electoral revisions, and provide every Indian with absolute, unquestionable legal certainty regarding their identity. End of story!

So who will give me a CITIZENSHIP CERTIFICATE? A govt bureaucrat?

The ministry of external affairs says that a passport is a document travel not the proof of citizen ship . Really ??? . So are they providing this travel document to some people with out being totally convinced that this person is an Indian citizen ?? . It is absurd .
