There there is a direct conflict between Jamaati #political_manifesto and the Constitution of Bangladesh, and that of course, requires to be settled first which MS Tania Amir attempted to settle; she won in a writ petition in High Court Division but subsequently fraustrated in Appellate Division due to political change of 5th August 2024. But it will be settled finally in future, i believe so. The Appellate Division judgment is per incurium since it directly conflicts with article 7 of the Constitution itself. So the judgment cannot operate as stare decisis (judicial precedent) under article 111 and 112 of the Constitution. It takes a favorable #political_atmosphere to discuss."
