Two of the most important anti-trust cases are now underway. The DOJ has kicked off the government’s case against Google and its anti-competitive behaviors used to dominate the search engine space.
The other is DOJ versus Agri Stats, initially a data reporting service that morphed into the authority on most aspects of the poultry and pork industries. Below is the mission statement from the company website.

Executive compensation, employee salaries, and consumer pricing all became intertwined through Agri Stats. Companies would report most aspects of their business practices to the agency. Agri Stats aggregates the data to ensure the anonymity of individual companies, buyers, facilities, and locations.
The industry may have suffered its own form of regulatory capture. A term for when the regulators become beholden to the banks or financial interests they are in charge of policing. Agri Stats was supposed to keep people honest by providing confidential, objective data, not catering to the players it was recruiting.
From the court filing, Agri Stats employees were more than willing to share specifics regarding competitors, pricing, and confidentiality. These are only a few of the allegations in the 60-page filing.
Easy Newz has focused on the anti-competitive behavior and the oligopolies within the agricultural sector because they often come at the expense of farmers, ranchers, and smaller players. This lawsuit includes retail and consumers. The Magnetic-Ag newsletter highlights the following quote from Agri Stats.
Agri Stats says it’s been fueling the U.S. economy by stimulating innovation and driving efficiency to help protein production reach low prices for consumers. The company also points to a 2012 DOJ antitrust investigation, which found no wrongdoing.
The argument that Agri Stats positive impact outweighs the abuse monopolies can have obfuscates the real issue: competition hurts farmers, consumers, and everyone not in a privileged position. The DOJ’s complaint cites two decades of monopolistic practices, but most specific actions happened after 2012, when the court found no wrongdoing.
The company shared customer pricing information with major suppliers, specific information between large industry competitors, and even discussed contingencies if competitors were not reporting. Most of these appear to be violation of the FTC and Sherman Act.

The antitrust laws proscribe unlawful mergers and business practices in general terms, leaving courts to decide which ones are illegal based on the facts of each case. Courts have applied the antitrust laws to changing markets, from a time of horse and buggies to the present digital age. Yet for over 100 years, the antitrust laws have had the same basic objective: to protect the process of competition for the benefit of consumers, making sure there are strong incentives for businesses to operate efficiently, keep prices down, and keep quality up.
The DOJ’s complaint shows an extremely high percentage of pork packers and poultry processors reported into Agri Stats: 90% of US broiler chicken sales, 80% of US pork sales, and 90% of US turkey sales.
A specific example is an Agri Stats employee confirming to Cargill where their wholesale price was to Wal Mart, HEB, and other groceries. Cargill then used to raise its pricing the DOJ alleges. Similarly, a Sanderson executive circulated a spreadsheet with customers instructing sales staff to raise wing prices that are deficient in Agri Stats.
Whatever the court decides, it is difficult to come to any other conclusion that companies were able to leverage this information with their customers. The below is from page 28 of the filing.
In a 2016 presentation slide entitled “Why AgriStats & Strategic Pricing?” (Fig. 9), Cargill explained that AgriStats provides “insight into competitor’s pricing” and identifies “what the market will bear.”
Consistent with the figures increasing the price curve, Cargill used Agri Stats data to raise prices. Beginning in late 2013, Cargill began relying on competitor data exchanged through Agri Stats to “increase [its] Benchmarking focus.” As shown below (Fig. 10), Cargill increased its prices from three cents below the national average to well above the national average as measured by Agri Stats’ net dock price. It would maintain those increased prices at least into 2016.
