INSTITUTIONAL MURDER AT IIT BOMBAY: THE CONSTITUTION DOES NOT PERMIT UNIVERSITIES TO BURY STUDENTS A 22-year-old second-year student of IIT Bombay's Energy Science and Engineering department is dead. Hours before his death, he was caught using ChatGPT during an examination. The institute says no disciplinary action was initiated, that the instructor and Head of Department counselled him and assured him the incident would not affect his academic career. He returned to his hostel room. He was found dead in the evening. This is the fourth student suicide at IIT Bombay this year. Two in the last two months. Over 400 students are protesting, demanding accountability and transparency. Mid-semester examinations have been postponed. The Director reportedly met protesting students four hours after the protests began. This is not a tragedy. This is institutional murder. The Articles of Association of a company create binding obligations. So do the constitutional duties of a university. Article 21 guarantees the right to life. The Supreme Court has repeatedly held that mental health is an integral component of this right. In Amit Kumar v. Union of India, the Court constituted a National Task Force and issued binding directions after taking judicial notice of the "disturbing pattern" of student suicides across Higher Educational Institutions. The Court held that HEIs cannot shirk their duty to provide a safe, inclusive, and responsive learning environment. It mandated that all HEIs must immediately report every student suicide to the police. It directed that residential HEIs must ensure 24×7 access to mental health professionals. The Court rejected the tendency to individualise blame and absolve institutions of responsibility. IIT Bombay has failed every one of these standards. Four deaths in one year. No visible institutional response. A director who meets students four hours after they begin protesting. This is not a failure of individuals. This is a systemic abdication of constitutional duty. The National Task Force identified structural causes: excessive academic pressure, rigid institutional policies, severe shortage of mental health professionals, and grievance redressal bodies that exist merely on paper. The UGC has issued guidelines mandating Mental Health and Well-being Centres and counsellor-to-student ratios of 1:500. These are not suggestions. These are mandatory obligations. The mother of the deceased has alleged "torture" and demanded justice. The students are asking a simple question: how many more? IIT Bombay is an Institution of Eminence. It receives public funds. It claims to produce the nation's finest minds. But it cannot keep its own students alive. An institution that cannot protect its students has forfeited its moral authority to call itself an institution of excellence. The Constitution does not permit universities to function as factories that consume students and discard them. Article 21 is not a suggestion. The Supreme Court's directions in Amit Kumar are not advisory. The duty of care owed by an educational institution to its students is not a favour—it is a constitutional obligation. IIT Bombay must be held accountable. Not with condolences. Not with statements of "deep sadness." But with an independent inquiry, a public report, and binding institutional reforms. No more deaths.
