The Saket building collapse, which claimed the lives of six young doctors and two computer engineers, is not merely the result of corruption within the MCD and lapses by the Delhi Police.
It also illustrates a far deeper problem, collusion between the judiciary and municipal lawyers.
In this case, Judge Amit Bansal of the High Court was presented with clear, repeated warnings that unsafe construction was underway, workers were digging a basement in an old building that already had a ground, first, and second floor, while adding two more floors on top.
The petitioners, who had repeatedly sounded the alarm, sought urgent intervention.
Instead of protecting public safety, the judge accepted the MCD’s affidavit and effectively compelled the petitioners to withdraw their challenge.
This is a familiar pattern: courts use procedural Pressure. threats of penalties or the option to “withdraw or be punished”, to push litigants into silence.
Social-welfare petitioners, unwilling to risk sanctions, withdraw quietly, and dangerous projects continue unchecked.
This case shows how institutional failures across civic bodies and the bench can combine to produce tragedy. If India is serious about upholding the Constitution and protecting citizens, it must bring judicial accountability into focus.
Judges who enable or tolerate such outcomes, whether through negligence, favoritism, or worse, should face meaningful investigation and appropriate sanctions so that public safety and trust in the legal system are restored @Cockroachisback
