Further sir I have mentioned in the email that Mr. Rameshwar Lal, SHO, Aravali Vihar PS on 09.07.2026 demanded Pre-FIR statement from me which is completely unlawful to which I declined as it is my right and I also explicitly mention my unreserved willingness to record my statement and completely cooperate with @AlwarPolice upon the registration of #ZeroFIR

I will be visiting your office today along with my email dated:08.07.2026 sent after complying with legal mandate of Section 173(4) of the #BNSS by submitting signed copy of emails dated:06.07.2026 & 07.07.2026 disclosing #CognisableOffences of serious #Fraud & #Cheating committed by Abhinav Agarwal, resident of 144,Alkapuri, #Alwar against @MEAIndia by acquiring #Passport valid till 15.04.2035 under #TatkalService by suppressing details of pending criminal Reg. case no.22/100/2024 in the court of Additional Chief Judicial Magistrate No.3, Alwar.
Sir as per #SupremeCourt and @HMOIndia directives police official have to register #ZeroFIR immediately if a complaint discloses Cognisable offences irrespective of the territorial jurisdiction and later transfer it to the concerned #PoliceStation

Sir I will just say if I have to go to court on the matter I promise you I will file a Writ Petition (Criminal) against your good self and Mr. Rameshwar Lal, SHO, #AravaliViharPoliceStationAlwar and will pursue it to the Supreme Court if I have to ensure strict action is taken for dereliction of duty and Abuse of Official Position.

Refusal to register #FIR when the complaint discloses #CognisableOffences by Mr. Rameshwar Lal, SHO, Aravali Vihar Police Station, @AlwarPolice is a clear violation of @HMOIndia advisory dated:10.05.2013 & 05.02.2014 clearly mentioned in Point No. 2 of OM No. 15011/91/2013-SC/ST-W dated:12.10.2015 no discrimination in compulsory registration of FIRs.
Point 2- that as per section 154 (1) of #Crpc a police officer is duty bound to register a case on the basis of such information disclosing a cognisance offence and FIR has to be registered irrespective of territorial jurisdiction.
The #SupremeCourt in Lalita Kumari vs State of Uttar Pradesh and Ramesh Kumari vs Govt. Of NCT Delhi clearly established that police officer/station has to “Zero” FIR immediately upon receiving complaint disclosing Cognisable offences under Section 154 (1) of CRPC (Section #173BNSS ) and FIR will be transferred to relevant police station.
In the matter of Abhinav Agarwal acquiring #Passport no.AA712593 valid till 15.04.20235 under #TatkalService from @rpojaipur by committing fraud and cheating, the Adverse Post Police Verification Report was sent by #AravaliViharPoliceStation Alwar and the property i.e. Passport no. AA712593 was delivered at 144, Alkapuri, Alwar-301001 which still remains in the custody of Abhinav Agarwal which falls under the jurisdiction of the same police station.
A passport is a property of Government of India as per Section 12 (1) (b) of the #IndianPassportsAct1967

It is to inform that I will be shortly visiting Aravali Vihar Police Station Alwar, @AlwarPolice to register FIR under BNS Sections 318, 336, 61 read with Section 12 (1) (b) of the Indian Passports Act, 1967 against Abhinav Agarwal s/o Sunil Kumar Agarwal, resident of 144, Alkapuri, Alwar-301001, Rajasthan for committing Fraud, Cheating and Criminal Conspiracy against @MEAIndia , Government of India for acquiring #Passport No.AA712593 (Validity: 16.04.2025 to 15.04.2035) under ‘Tatkal Service’ by Suppressing Vital Information regarding pending Criminal Reg. Case No.23/100/2024 in the court of Additional Chief Judicial Magistrate No. 3 Alwar.
Please find details of offences committed by Abhinav Agarwal below:
1) I filed FIR no.277/2024 dated:29.04.2024 against Sunil Kumar Agarwal, Abhinav Agarwal and Ravindra Agarwal in Aravali Vihar Police Station, Alwar.
2) The Court of ACJM No.3 Alwar took Cognisance and via order dated:02.12.2024 framed charges against the accused under sections 323, 452, 354, 504, 506 read with section 34 IPC.
3) The accused Abhinav Agarwal upon expiry of his old passport no.M6318010 on 22.02.2025, applied for passport renewal under Tatkal Service on 10.03.2025 at @rpojaipur after which following SOP Passport No. AA712593 (Valid till 15.04.2035) was issued vide file no.JP1074935362125 and dispatched to Abhinav Agarwal on his residential address.
4) Abhinav Agarwal after receiving passport no.AA712593 knew very well that he suppressed details of pending criminal case from #RPOJaipur and his criminal act will come in front of authorities upon Post Police Verification and legal action will be taken against him under section 12 (1) (b) of #IPA1967 so he approached trial court on 14.05.2025 stating that his passport expired and he is applying for passport renewal but the Aravali Vihar Police Station is not doing his police verification because of pending criminal case.
Another application dated:15.05.2025 was submitted by Abhinav Agarwal in trial court where he ‘admitted that his passport expired after which he applied for passport renewal and he received the new passport’ but with criminal intent never mentioned old and new passport number with a clear intent to mislead the court in issuing ‘NOC’ so he could evade legal action under section 12 (1) (b) of IPA 1967 and just attached the copy of passport no.AA712593
Both applications were rejected vide order dated:15.05.2025 by the court of ACJM No.3 Alwar.
5) As per established protocol the Aravali Vihar Police Station Alwar did the Post Police verification and sent ‘Adverse Police Verification Report’ to @rpojaipur after which Show Cause Notice no.SCN/1049293492/25 dated:29.05.2025 was issued to Abhinav Agarwal under ‘ PVR Review’ category.
6) Abhinav Agarwal now entered in criminal conspiracy with @VipulStories , Regional Passport Officer, RPO Jaipur and delayed the legal action under section 12 (1) (b) and approached trial court again on 06.10.2025 with completely different facts and stated that ‘Passport no.AA712593 was issued on his name which has expired and for renewal Vipul Dev has demanded NOC from trial court’. The application was rejected vide order dated:09.10.2025 by court of ACJM No.3 Alwar.
7) Abhinav Agarwal filed review petition no.98/25 on 16.10.2025 in the District & Sessions against order dated:09.10.2025 which was rejected via order dated:09.02.2026 by the court of ADJ No.3 Alwar.
