This provision is Section 70A of the Information Technology Act, 2000 (National Nodal Agency for Critical Information Infrastructure Protection).
Section 70A – National Nodal Agency for Critical Information Infrastructure Protection
(1) The Central Government may, by notification published in the Official Gazette, designate any organisation of the Government as the National Nodal Agency for the protection of Critical Information Infrastructure (CII).
(2) The National Nodal Agency designated under sub-section (1) shall be responsible for all measures relating to the protection of Critical Information Infrastructure, including Research and Development (R&D) activities concerning its protection.
(3) The manner in which the agency referred to in sub-section (1) shall perform its functions and duties shall be such as may be prescribed by the Government.
Section 70A empowers the Central Government to designate a National Nodal Agency for the protection of Critical Information Infrastructure (CII) through a notification published in the Official Gazette.
Critical Information Infrastructure includes essential sectors such as power, banking and financial services, telecommunications, defence, transportation, and Government information systems, where the incapacitation or destruction of such infrastructure would have a debilitating impact on national security, the economy, public health, or public safety.
Under this provision, the has been designated as the National Nodal Agency responsible for coordinating the protection of India's Critical Information Infrastructure, including cybersecurity measures, policy coordination, research, development, and technical guidance.
