L’affaire du lithium de Manono révèle un paradoxe embarrassant pour le gouvernement congolais :
l’administration Trump semble traiter DATHCOM comme une entité toujours valide, alors même que Kinshasa affirme l’avoir officiellement annulée.
En théorie, l’État congolais a dissous la joint-venture DATHCOM et récupéré la totalité du permis minier PR13359 via la COMINIERE, effaçant les 75 % détenus par l’australien AVZ. Mais dans les faits, Kinshasa continue de reconnaître les 15 % du chinois #Zijin au sein de cette même structure, notamment en validant une transaction de plus de 33 millions de dollars liée à la vente de parts.
Une contradiction qui affaiblit juridiquement sa position.
Washington, lui, pousserait pour que les parts d’ $AVZ dans le gisement soient vendues à une entreprise américaine.
Or vouloir négocier avec AVZ revient implicitement à reconnaître ses droits dans DATHCOM, et donc l’existence de la joint-venture.
Autrement dit, les États-Unis agissent comme si l’annulation décidée par Kinshasa n’avait jamais vraiment tranché la question.
Ce décalage met en lumière une incohérence congolaise :
- comment annuler DATHCOM tout en validant certaines de ses transactions ?
- comment affirmer la souveraineté minière tout en laissant des acteurs étrangers arbitrer les faits ?
La question devient politique :
Kinshasa est-il prêt à assumer un bras de fer avec Washington et les investisseurs internationaux, ou devra-t-il revenir sur l’annulation de DATHCOM pour sécuriser des partenariats stratégiques ?
Dans cette bataille autour du lithium ressource clé de la transition énergétique mondiale, la RDC risque de payer le prix de ses propres ambiguïtés.
Car sans position claire et juridiquement solide, ce sont les puissances étrangères qui finiront par définir la réalité du terrain.

Legal passing is showing Cominiere acted illegally removing #Dathcom $AVZ. That licence is still live, just in the hands of the wrong ‘operator’.
