Exploring all sides: a sound pro-impeachment narrative favoring Ranger #DavidMaxwell, with a relevant clip at the end. No one should doubt his overall honorable service, or even that of the whistleblowers; the question is whether their takes justify #KenPaxton’s banishment.
Closing out the week in the #PaxtonImpeachmentTrial was the testimony of Texas Ranger David Maxwell. There’s a lot to unpack, so let’s dive in:
First, Ranger Maxwell is a legitimate Texas hero, and it is difficult to imagine that his testimony did anything but catch the attention of the Senators in the Impeachment jury. He comes across as a folksy, Andy Griffith type guy sent from central casting to play the role of tough Texas lawman.
His allegations were powerful and for most of his time on the stand, extremely credible. The defense team would be foolish to discount the potential damage he caused to Ken Paxton with his testimony — far more than the “whistleblowers” who testified earlier in the week about their grievances regarding the Attorney General committing the unpardonable offense (in their eyes) of running his own office.
Ranger Maxwell’s core allegations related to an investigation that Paxton thought was justified, but Maxwell did not: “[if we] conducted that investigation we would have committed several federal crimes… obstruction of justice and interfering with a federal investigation”
The investigation that he’s referencing is the one that Nate Paul had advocated for and Paxton assisted with. The short story on this is that after Paul had been raided by the Feds, he came up with a theory that the Feds did him dirty by illegally altering the search warrants after the fact to expand their scope. His technical experts theorized that there was altered metadata in the digital versions that proved that the documents were changed.
Paxton was open to this theory and agreed to help Nate Paul run it to ground. Eventually, as Paxton’s Deputy Attorney General for Criminal Justice, it became Maxwell’s problem to solve, and he eventually met with Paul three times that summer. After initially “googling him”, Ranger Maxwell –– developed the opinion "that Nate Paul was a criminal and that we should not be associated with”. Accordingly he dragged his feet and ultimately refused to open an investigation into the alleged FBI and DPS misconduct. Paxton, convinced of the idea the FBI was untrustworthy eventually hired outside counsel to help explore & adjudicate Paul’s claims (an act that would eventually become the catalyst for the “whistleblower” complaints).
During his testimony Friday, Maxwell effectively advocated his belief that it was an abuse of the Attorney General’s Office to help adjudicate or even consider the federal misconduct claims Paxton’s friend had reported. Paxton’s lawyer was deferential and respectful for most of the cross-examination, but it went sideways toward the end of the day:
When pushed on the speculative nature of many of his claims and how he was failing to make clear delineations between what he KNEW vs what he SUSPECTED, Maxwell demurred and argued that all he did was “give an investigative committee a lead to go and investigate”. Which of course if you’ve been following along since last May you know that the #txlege House committee that rushed the Impeachment resolution through on a holiday weekend with 48 hours notice didn’t ACTUALLY critically evaluate anything their Democrat led “investigation” turned up.
This didn’t sit well with Paxton’s lawyer Dan Cogdell who appeared to be building up to accuse Maxwell of leveraging his vast experience at being a savvy witness to deliberately obscure the fact that he wasn’t speaking with “personal knowledge” when all heck broke loose.
After Cogdell suggested he was playing games from the witness stand, Maxwell sheepishly smirked and said “maybe” which elicited laughter in the Senate Chamber. Cogdell wasn’t impressed and quickly & sternly accused him of playing a “game to throw people off” instead of “testifying to the truth”. Maxwell dramatically paused and stared Cogdell down and then became even more recalcitrant with the remainder of the cross. Boys will be boys one supposes.
Maxwell comes across as someone who is the smartest guy in every room he enters, and whether his penchant for playing fast & loose during his testimony impacts the Senator’s evaluation of his overall testimony remains to be seen.
But his testimony – while extremely clear & credible throughout – echoed the testimony of the whistleblower wunderkinds from earlier in the week who were disgruntled that the elected Attorney General was doing something that in their personal estimation was improper, and potentially illegal.
Maybe. But there sure seem to be a lot of Indians who fashion themselves Chiefs in this story.
