DAY 3 of #ELRASE Panel Sessions of the Employment and Labour Relations Annual Symposium and Exhibition (ELRASE) which has brought together judges, practitioners, academics, and stakeholders to discuss emerging issues in labour law and justice, interrogated the elimination child labour in Kenya under the topic: ‘Kenya and Comparative Jurisprudence on Elimination of Child Labour Including Worst Forms of Child Labour and Access to Justice.’ The discussion centred on decided cases on child Labour including worst forms of child labour; cases from Criminal, Civil, Employment, Constitutional, Judicial Review and Children Courts; and decisions by administrative agencies involved in protection of children and enforcement related laws.
The panelists noted that child labour as an offense has not been pursued adequately by the justice sector actors. Further, the forum heard that the law is not very clear on offences related to child labour and that there is lack of awareness on child labour-related laws. The participants underscored the need for stakeholders to create awareness on child labour laws and putting in place legislative measures to make these laws clearer. They called for the need to embrace a child rights approach when dealing with child labour issues.
