It's taken years, but some principles:
- personal service and payment, with some control does not mean a default finding of employment at all.
- one must look at nature of mutual obligations and the degree of control, along with all other factors.
- HMRC tried to say mutuality was just payment (they were wrong on that), and tried to say control was binary and degree not relevant (they were wrong on that), and tried to say payment and some control meant a default finding of employment (they were wrong on that too).
HMRC's longstanding "Policy View" on status, DID NOT get over the line at the Court of Appeal in Atholl House (thank you @kayeadams), nor at the Supreme Court (thank you PGMOL).
All of you that were given status determinations and tax bills based on that misguided HMRC policy view can consider yourself similar to the victims in the post office - you were told you owed them money, when in fact, you may not have done.
