I strongly condemn this regressive interpretation of workplace harassment.
Harassment is not only about sexual advances or sexual desire. *Intimidation, humiliation, gender-based discrimination, victimisation, abuse of authority and creating a hostile work environment can profoundly damage a person's dignity and ability to work.*
By narrowing the Protection Against Harassment of Women at the Workplace Act to conduct with a “sexual dimension,” this judgment risks leaving serious workplace abuse outside the Ombudsman's reach even when it is rooted in power, gender discrimination or domination. [The Express Tribune]
A woman should not have to prove that the person abusing, humiliating or intimidating her was sexually motivated before the law takes her complaint seriously.
If the conduct is abusive, discriminatory and creates a hostile workplace, *it must have an effective legal remedy.*
Otherwise, we are telling victims that unless the abuse is sexual, their dignity does not count.
Workplace safety means freedom from harassment, discrimination, intimidation and abuse of power not merely freedom from sexual advances.
