April 2019: Thanks to @Tonymauro, I and my @rcfp colleagues were invited to hear FMI v. Argus Leader, a case dealing with #FOIA's #Exemption4. Here's a quick write up (by me!) when the Court decided to take the case. ⬇️

@rcfp @_blip_ A5: True. And this is why the Open and Responsive Government Act of 2019 is one of the crucial bills we are advocating for to help tilt the scale in favor of the public's right to know & accountability https://t.co/qujIS0YowI

.@RCFP: "We should be greatly concerned that #SCOTUS broadened what is confidential under #Exemption4 of #FOIA."
@_blip_ A5. #SCOTUS has made it easier for companies to keep secret commercial or financial information submitted to the federal government away from the public. We should be greatly concerned that #SCOTUS broadened what is confidential under #Exemption4 of #FOIA. #SunshineChat2020 (1/2)

Great decision! The Sup Court correctly decided that "confidential" means private and secret. Grocers have always kept sales data secret & @USDANutrition has long provided assurances to them that it would not disclose their data. Congrats to @FMI_ORG & @NGA_GR #Exemption4 #FOIA
Now we'll never know how much money the Walmarts of the world make from taxpayer-funded benefits like SNAP. Because it's "confidential." @hclaire_brown reports: https://t.co/wzRPZRMNM3

Today, #SCOTUS issued a decision in FMI v. Argus Leader, a case we highlighted in our #SCOTUSFOIA chat back in April that had implications for #FOIA and #Exemption4. In response, @foropengov has issued the following statement. https://t.co/E8Ztb3kvQZ
SCOTUS ruled Monday against @Argus911 newspaper by a margin of six justices to three in the FMI v. Argus Leader Media case, blocking the release of information and thereby expanding the scope of documents that are exempt from public disclosure. #Exemption4 https://t.co/iElH115eT3

.@morisy offers some background on yesterday's #exemption4 #SCOTUS hearing, and what it could mean for #FOIA https://t.co/UfqCzOtlpK

We wish they would have talked more about the merits of releasing SNAP expenditures to the public, but #Exemption4 was the main focus. The @argusleader has worked tirelessly to get this information into the hands of the public, where it belongs. #SCOTUSFOIA
Hey @foropengov colleagues: Did the justices seem to pay any attention to the merits of releasing SNAP expenditures? Or was this primarily about #Exemption4 itself? #SCOTUSFOIA
By also getting rid of National Parks test, by giving "confidential" an ordinary meaning could also mean trouble for states whose state exemptions are very similar in language to #Exemption4. This case has many state policy implications beyond the @argusleader. #SCOTUSFOIA
@foropengov Seemed to be some discussion on circuit split re: definition of "substantial competitive harm." Can you clarify the main discrepancies in various interpretations of the test?
Although this is a #FOIA case and we all care about the future of #Exemption4, today, the justices were focused on standing and statutory interpretation principles to settle the question of the meaning of the word "confidential" when interpreting Exemption 4. #SCOTUSFOIA
FMI argues that the plain language of #Exemption4 shows that the requested data is commercial or financial information. Under a D.C. Circuit case called National Parks, the govt. can only withhold records if releasing them would cause "competitive substantial harm." #SCOTUSFOIA
