"This SRO being a subordinate legislation prohibited the activities of #AwamiLeague under section 18 of the Anti Terrorism Act, 2009.
This SRO could be #annulled at any point of time because it is #inconsistent with the object and purpose of the #AntiTerrorismAct2009. More importantly, prohibition of political activities of AL is inconsistent with #Article38 of the #Constitition, because AL as a registered political party fulfills all four constitutional criteria as mentioned in article 38 of the Constitution. Whereas, #Jamaat does not fulfil any of the constitutional criteria to function as a valid #political_party, because it believes in theocracy, not in constitutional governance of modern #democracy of peoples sovereignty [Art 7 (2)]. To Jamat, sovereignty lies in some other place of supernatural power of divine origin as alleged by them. There there is a direct conflict between Jamaati #political_manifesto and the Constitution of Bangladesh, and that of course, requires to be settled first which MS Tania Amir attempted to settle; she won in a writ petition in High Court Division but subsequently fraustrated in Appellate Division due to political change of 5th August 2024. But it will be settled finally in future, i believe so. The Appellate Division judgment is per incurium since it directly conflicts with article 7 of the Constitution itself. So the judgment cannot operate as stare decisis (judicial precedent) under article 111 and 112 of the Constitution. It takes a favorable #political_atmosphere to discuss."
