Chief Justice Mandisa Maya has warned that the failure by courts to function effectively will weaken the rule of law and compromise public confidence in the justice system. Speaking at the 2026 #JudiciaryConference taking place in KwaZulu-Natal, Maya highlighted several challenges facing courts in the country, which include failing infrastructure, inadequate translation services, limited to no research support services as well as dysfunctional digital systems. The conference brings together Judicial Officers from across the country to reflect on matters critical to the administration of justice and the future of the judiciary. Maya has also noted that while the South African judiciary enjoys adjudicative independence, institutional independence remains an unfulfilled goal. She adds that the administration of the superior courts and of the magistrate level remains fragmented. IMS
