The Complainant owns Australian #trademark registration for MAGIC MEN, registered on January 7, 2014, subsequently assigned to the Complainant. The Respondent is an individual who owns a US-based entertainment company that has in the past operated in the US similar live performance events. The Respondent holds or held trademark registrations for MAGIC MEN and MAGIC MEN LIVE in the US (registered on December 2, 2014, now expired), Canada (2017) and UK (2016).
The disputed Domain Name was registered on February 7, 2015 and does not currently resolve to an active website. The Respondent says that the Complainant has reached out to the Respondent directly to inquire about the sale of the domain and other digital assets. The Panel does not see how the Complainant could have certified “that the information contained in this Complaint is to the best of the Complainant’s knowledge complete and accurate” without disclosing fully this background including the communications the Respondent has produced @ https://t.co/x1U1QA7D8g

Nothing is known regarding the nature of its business other than that it is the owner of the MAGIC MEN trademark, registered on January 7, 2014. Around July 24, 2025, the Complainant asked a domain broker to contact the Respondent about buying the #domainname. On August 6, 2025, the broker said the Respondent was unresponsive but would keep trying. The disputed domain name was registered on April 6, 2002. The Respondent produces a range of evidence to support its submissions regarding its longstanding magic hobby
The Panel is satisfied on the evidence before it that it is reasonable to infer that the disputed domain name was registered by the Respondent in 2002. The lack of registration in bad faith due to such registration predating the accrual of the Complainant’s rights renders the question of use in bad faith moot due to the conjunctive requirement in paragraph 4(a)(iii) of the Policy. Further, the Respondent has been put to the time and trouble of preparing a full Response under the Policy together with having to gather together what amounts to a remarkable collection of evidence dating from the late 1990s, in a case that should never have been brought under the Policy... @ https://t.co/xfTt0NZuu5
