Free Speech Is Protected. Paid Manipulation Is Not. At the House hearing on disinformation, everyone agreed on two things: free speech must be protected and fake news is a problem. What no one could agree on was how to define or litigate “truth.” And that’s where we’ve been looking at the problem incorrectly. The data makes this clear: disinformation today is not a truth problem, it is an amplification problem. Paid disinformation consistently reaches 4 to 8 times more people than organic content. This is not citizen speech competing in a free marketplace of ideas; this is narrative dominance purchased through money and infrastructure. Freedom of speech is constitutional. Freedom of reach is not. Compounding the issue, AI truth-detection tools, often proposed as a solution, are deeply unreliable, with accuracy rates hovering around 60% at best. Basing regulation on such systems would create more harm than clarity. Organized disinformation now functions like organized crime: coordinated, funded, strategic, and designed to manipulate public behavior at scale. What we need to regulate is not content, but the commercial systems and money flows that artificially amplify deception. We can safeguard democracy without censoring speech by targeting paid reach, mandating transparency, and disrupting disinformation supply chains. The focus must shift from policing truth to regulating manipulation infrastructure, because that is where the real danger lies.
