I appreciate Colin's original post focused on #MultInvCourt. Nevertheless, substantive protections are crucial to EU/MS overseeing what types foreign capital come in. Continued effort by EU/MS to address climate but I wonder when see move to positive list, rather than carve-outs.

���🏻is a key issue for #MultInvCourt. States are not replacing ISDS w/ a permanent court but laying it overtop of it & three decades of community experience. Key to court success is building up stakeholder/SSDS communication alongside court to work out treaty goals and past errors.
I favor No 3. because new adjudicators may get new IIAs right, but will still struggle with old IIAs. Claims will then be diverted from new to old treaties.
--> We end up where we started.
Hence @unctadwif's emphasis on tackling outdated treaties is most promising in long run.
@w_alschner @jbentonheath This strengthens the argument that the current system of ad hoc arbitration has proven itself not able to guarantee legal 'correctness', let alone legal 'consistency'.

One deal does not signal a shift in overall thinking away from #ISDS. Canada agreed to remove ISDS w/ the US in the USMCA. Its 2021 model treaty keeps private direct enforcement in, while stressing innovations and supporting #MultInvCourt.

In keeping with the UNCITRAL #MultInvCourt process, the Canadians acknowledge the potential for an appellate mechanism in the future.
Is UNCITRAL the right forum for debate about the ongoing use of #ISDS? There is no guarantee States will align #ISDS reforms. Each govt determines investment facilitation and protections (even the EU&MS have negotiated w/o imposing the #MultInvCourt as a redline).

But one question I hope the UNCITRAL WG III will consider for #MultInvCourt, whenever travel is made possible and these officials can come together to meet and talk-that they take seriously to ask WHERE the text is done. They need to take seriously that this question matters too.
