There is this legal theory about the spirit of the law versus the letter of the law. The letter of the law states that you’re not allowed to own wild animals in the state of New York. It was written in the spirit that you shouldn’t be able to own animals that might pose a danger to the public or the environment, such as a rabies-carrying bat or something equally dangerous. The spirit of the law would also suggest that the law wasn’t written to kill a domesticated squirrel that survived as a rescue and lived as someone’s pet for almost a decade. Real cops understand this. It’s why most of them (barring some exceptions) wouldn’t pull you over for driving 1mph over the speed limit. The issue with these law enforcement agents from the NYSDEC is that they’re desk jockey bureaucrats. They’re not real police. And so they take the opportunity to flex their legal muscles wherever and whenever they can get it. This entire fiasco with Peanut the squirrel was an exercise in the unjust application of the law.
