#OurView “Quando aliquid prohibetur ex directo, prohibetur et per obliquum” -[meaning: What cannot be done directly cannot be done indirectly ] This is an oft quoted maxim in many judgments of the Supreme Court. This maxim, in our view, is applicable not just to the executive and the legislature, but also to the judiciary. Having held that same sex marriage cannot be legalised by it, the Court could not have just made a mirror image of marriage and name it as a 'union'. CJI attempted to do it. Justice SK Kaul endorsed it. But other judges [Justices Bhat, Kohli, Narasimha] applied the maxim and refused to do it. We respect the queer community in India and elsewhere and would love if the State (Union or State Governments) makes suitable laws recognizing their right to union. But having read all the judgments/opinions by the Supreme Court, we believe that majority is quite justified in holding what it held. This is just our opinion. You can share yours ! #OurView Parliament, and not the Supreme Court is always the authority to make laws on procedure re : appointment of Election Commissioner. The Supreme Court issued guidelines because no such law was made by the parliament. The Supreme court itself said that these guidelines are in force until the Parliament makes a law in consonance with Article 324(2) of the Constitution. It is a different thing if the argument is that the present law is not in consonance with Article 324(2). The fact that the Committee proposed under this Bill does not include CJI will not be violating Article 324(2). But can it be called a 'dilution of the Supreme Court judgment'? 'No' is our view. What do you people think?

Centre moves to dilute another Constitution bench judgment of SC, Bill on appointment of CEC and ECs states that that Selection Committee will comprise of PM, LoP in Lok Sabha and a Cabinet Minister. SC in March 2023 had said appointment of CEC and ECs shall be done by the President on recommendation of Committee of PM, LoP and CJI.
