#RDNH #pluggable.com. The Complainant, Leancode, Inc. (USA), sells computer accessories and peripherals under the trademark #PLUGABLE (US registration, first use September 2009), a deliberate misspelling of the dictionary word "pluggable." The Respondent, Richard Harrison (UK), registered the disputed domain name in February 2009, before the Complainant acquired any trademark rights and operated a consulting company named Pluggable Ltd. from 2007 until 2012.
In 2025, the Complainant's own founder publicly acknowledged on Reddit that "https://t.co/BSPcXUyXCy wasn't available, and can't be trademarked," which is why the Complainant chose the modified spelling PLUGABLE instead. Notwithstanding this, the Complainant filed a UDRP complaint arguing that the Respondent's 2026 reactivation of the domain for email use and its offer to sell at a mid-six-figure price should be treated as a new registration date for bad faith purposes.
The three-member Panel unanimously rejected that argument, holding that neither a period of non-use nor a later change in use can retrospectively convert an originally good-faith registration into a bad-faith registration, and that the Policy contains no provision supporting any "reset" of the registration date. The Panel found the Complaint had no reasonable prospect of success and should never have been filed, particularly given that the Complainant was represented by counsel and its own founder had publicly contradicted its #UDRP position just one year earlier @ https://t.co/OzTKIHiye7
