Privilege traps. In law, we deal with a lot of issues surrounding confidentiality and privilege of documents. Often there are disputes in litigation as to whether a set of documents are properly privileged. As a rule, these are resolved in front of a judge. Sometimes a party will offer opposing counsel the opportunity to inspect the documents. But on condition they don’t disclose the contents to their client. This creates a significant problem for counsel as they will have seen something which they then cannot discuss with their client. Thus they cannot get proper instructions and frankly it creates a wedge in the relationship between counsel and client. As a lawyer, I never agree to these offers for this reason. Thus, when the Cons and Bloq decline to view confidential documents in order to be thereafter unable to share the contents with the public or otherwise comment on the issue, I get it.
