The purpose of a Quash Petition filed under Section 528 of the ₹/#BharatiyaNagarikSurakshaSanhita (BNSS), 2023 is to seek the #quashing of an FIR or criminal proceedings, and not to serve as a substitute for an #AnticipatoryBailPetition for protection against arrest.
As repeatedly emphasized by the Supreme Court, a Quash Petition cannot be converted into an Anticipatory Bail Petition. Therefore, merely because a Quash Petition is pending, courts generally do not grant long-term or absolute blanket protection from arrest without quashing the proceedings themselves.
The appropriate legal remedy for protection against apprehended arrest is to file an Anticipatory Bail Petition under Section 482 of the BNSS. A Quash Petition and an Anticipatory Bail Petition are fundamentally different in their objectives, the legal issues they address, and the reliefs they seek.
Accordingly, as a well-established principle of criminal jurisprudence, a Quash Petition is a remedy for quashing criminal proceedings, not a mechanism for obtaining anticipatory protection against arrest.
