Como observador desde #Colombia, el caso de Qwen 3.5 no es un error técnico: es la demostración clara de lo que ocurre cuando un Estado define los límites de lo que una IA puede “saber” o decir.
En el litigio #ThomsonReuters v. #ROSSIntelligence —hoy en apelación ante el Tercer Circuito— la cuestión de fondo es si el entrenamiento de modelos sobre bases de datos jurídicas constituye un uso transformador protegido por fair use.
Una resolución que reconozca ese carácter transformador, sin anular incentivos razonables a la creación de contenido, no solo fortalecería la innovación estadounidense: sentaría un estándar que beneficiaría a países como el nuestro, donde el acceso eficiente a la información jurídica sigue siendo un cuello de botella para democratizar sistema legal y administración de justicia.
