Below are some thoughts and key questions that everyone should be concerned with, especially the @SECGov based on their "admission" that such activity is prevalent:
1. On Regulatory "Awareness": it is comforting to see the SEC finally admit that the 'fair and orderly markets' they oversee are actually 'especially vulnerable' to rampant manipulation—is the new $5 million threshold a SAFETY NET, or just a admission of where the surveillance team just stops looking⁉️
2. On the "Ramp-and-Dump" Admission: Since the Commission now explicitly cites '$15 billion in ramp-and-dump losses' as the PRIMARY justification for these new rules, should we conclude that the SEC’s previous listing standards were essentially a VIP invitation for schemes to flourish on Nasdaq? As a CEO who has never sold a single share, it is fascinating to see the Commission finally admit the markets they oversee are 'especially vulnerable' to manipulation. If the SEC is so concerned about 'bad actors' exerting control, why is it proposing a MECHANICAL $5 million trigger that provides a literal ROADMAP for predatory short sellers to force legitimate, non-selling insiders off the exchange⁉️
Congratulations. Predatory traders now have a specific target… driving the MVLS below $5 million, to trigger an automatic, immediate suspension.
3. On "Self-Help" Regulation: If large retail brokers are already taking 'self-help actions' to block trades because the exchange standards are so porous, is the SEC’s new rule a proactive policy or just a desperate attempt to catch up to the reality that manipulation is the current status quo⁉️
Since the Commission is citing Jeffrey Starr at Charles Schwab… to justify these rules… should we interpret this as a formal admission that the SEC has effectively OUTSOURCED market enforcement to private RETAIL brokers⁉️
