Perhaps the European officials are assuming Putin would no longer be in power if the #STCoA could try him in person -- in which case he would no longer have personal immunity. That's the only way to make legal sense of the supposed in absentia/in person distinction.

Others will be (understandably) disappointed that the #STCoA will leave personal immunity intact. The expressive cost is real. But the practical import will be zero, with the exception that the tribunal would not be able to prosecute the troika in absentia.
Some will be (understandably) disappointed that the #STCoA will not be truly international. But there is simply not enough political will among either European or Southern states to create such a tribunal. That was the case two years ago, and it is even more true now.
Great to see concrete progress being made toward a #STCoA. It has been nearly 26 months since @SZarifi, @Dr_OOwiso, and I firsrt suggested that an internationalized tribunal be created through a #Ukraine/@coe agreement. And now that seems to be what is going to happen.
I welcome today's decision by @coe's Committee of Ministers on the Special Tribunal for the Crime of Aggression Against Ukraine, and I thank all of its members who supported the move.
This significant decision directs the CoE Secretary General to prepare the necessary documents to facilitate consultations in the Core Group on the Tribunal and the potential project of an agreement between Ukraine and the Council of Europe on its actual establishment.
The vote also approves further work on the possible additional agreement to organise support for such a tribunal, its financing, and other issues.
This is an important practical step towards putting the tribunal into action. Each such step brings us closer to proving that justice for the crime of aggression against Ukraine is inevitable.
We continue to work to ensure that a fully operational tribunal delivers this justice. This is critical not only for all Ukrainians who have suffered as a result of Russian aggression, but also for all nations seeking to live in a peaceful and secure world.

Today @James_JosephTDL held an important meeting with the 2022 Nobel Peace Prize winner and director of The Centre for Civil Liberties Ukraine, Oleksandra Matviichuk, on #IWD2024 to discuss the war in Ukraine, work towards the #STCoA and assisting 🇺🇦 civil society.
The OTP is also actively supporting the International Centre for the Prosecution of the Crime of Aggression -- something it wouldn't do if the Prosecutor was opposed to an #STCoA, given that the explicit mandate of the ICPCA is to develop evidence for an aggression tribunal.

This resolution was drafted and circulated months ago. The call for an #STCoA was then watered down into a meaningless call for accountability -- because states wouldn't support it. It's time to acknowledge the only way forward for #aggression is an internationalized tribunal.

Excellent @dawnmclancy article. But it is not the case that an #STCoA "clears a legally sound path" for setting aside personal immunity. That path would require overwhelming UNGA support for an STCoA, which does not currently exist and is unlikely to ever materialise.
