🐘 HOW ARE SENTIENT BEINGS BEING ANIMALS GIVEN AS “GIFTS” TO TEMPLES OR STATE? WHAT IS THE REALITY BEHIND IT? 💔 On 2 September 2026, the Madras High Court lifted the blanket ban on temples and private individuals acquiring elephants. Almost immediately, five young elephants from Assam, Durga, Shiva, Hiralal, Rupsing and Bijuri, were cleared for transfer to Tamil Nadu temples, raising serious concerns about their future and separation from their families. And here is the disturbing irony: the same bench that allowed temple acquisition did not permit the very old elephant Abhayambigai to retire from Shri Mayuranathaswamy Temple, Mayiladuthurai, where she has reportedly spent more than half a century in captivity. The world saw videos of five-year-old Durga distressed and chained at Meenakshi Amman Temple. But what happened when she was reportedly taken from the Manas National Park area late at night? What about the family she left behind? Elephants are reportedly being transferred to Tamil Nadu temples as “gifts” or “donations” amid allegations that commercial transactions may be disguised through such arrangements, since trading elephants is prohibited under Indian law. It has also been alleged that private owners are persuaded to “donate” elephants by stating that they can no longer maintain them. Is the Assam Forest Department conducting adequate due diligence, or are deeper questions being overlooked? Young elephants have reportedly not been brought to Tamil Nadu temples in this manner for around a decade. Now five-year-old Durga has arrived, while four more elephants are reportedly awaiting transfer. Sources have put their alleged black-market value at nearly ₹1 crore. If these are merely lawful transfers, then the public deserves transparency: Who owns them? Where did they come from? Why are they being transferred? What was paid, or donated? And were every required safeguard and welfare assessment followed? The Wild Life (Protection) Amendment Act, 2022, introduced by the Union Government, inserted a proviso under Section 43(2) permitting the transfer or transport of captive elephants for “religious or any other purpose,” subject to the law. But legality should never end the conversation about welfare. Have we lost sight of compassion? Do sentient beings deserve decades of chains, concrete and confinement in the name of “tradition” and money? We urge @CMOTamilnadu , @tnforestdept and @CMOfficeAssam , @moefcc and respectfully call for complete transparency and welfare-focused scrutiny of these transfers. The old elephants are still there.
