#Tafelberg #SpatialJustice @ConCourtSA Explicitly ruled against the commodification of public land. Land or property value is not a valid consideration for a government with a constitutional duty to spatial transformation. Helen Zille once told me using high value well located public land for affordable housing was “over subsidising the poor” 🤯 Now she knows she was wrong. More importantly housing as a human right trumps property as an investment for government. Government is in the business of providing housing. #SpatialJustice @ConCourtSA Celebration at Sea Point Methodist Church where housing activists gathered to watch the ConCourt judgment. Court boldly & unequivocally asserted the right to the City and the duty of our City & Provincial governments to take meaningful steps to reverse apartheid spatial plan. Land value - commodification of property - is not a relevant factor the City can take into account! Major victory, including a micro-management plan of these governments, for spatial justice. @ReclaimCT @NdifunaUkwazi

Location of housing must be taken into account in determining what constitutes reasonable delivery of housing; b. Sea Point is included in CBD for social housing delivery; c. Province must submit a report under oath setting out its affordable housing plans; d. A report of housing delivered since the commencement of this litigation must be provided (BIG PROBLEM: The answer is ZERO). Report must include similar information about housing in or around City Centre. #Tafelberg #ConCourt #SpatialJustice @ConCourtSA: Unanimous judgment: @CityofCT & @WesternCapeGov City of Cape Town remains divided. The matter is about full access to the City about “Right to the City”. Location is not a peripheral to housing access. State bears a burden to align with Constitutional transformation. City had failed to provide any housing in well located areas. No justification for City’s policies lacking geographical location considerations. No justification for failing to provide housing in Sea Point. City cannot use land value as a basis for denying access to housing. (Helen Zille told me “using high value land for affordable housing was over subsidizing the poor”) City and Province has failed in their constitutional duties to provide well located affordable housing and to address spatial apartheid. VICTORY! Disposal of Tafelberg School site by WC Government was unlawful. @ReclaimCT @NdifunaUkwazi 👏👏👏
