Dear @idringp !
Feedback is food for champions. We appreciate it profoundly for it offers an opportunity to engage and a platform for tax education.
Please allow us to indulge your followers in a few elements about Uganda's tax system that they should know about and how it relates to the taxpayers in the entertainment sector. Kano kawanvumu!
Is the tax regime in Uganda fair?
Here are a few facts that would suggest so. The first one is the provision to ease business people into compliance.
If a business person (artist, comedian or shopkeeper) turns over less than Ugx 10 Million a year, that business person doesn't qualify to pay tax. When their fortunes get better and they turn over more than Ugx 10 Million a year but less than Ugx 150 Million, they join the league of taxpayers as small business taxpayers (presumptive taxpayers).
Businesses that are beyond the Ugx 150 Million threshold are considered mature for tax purposes and are no longer small businesses and here, they are required to derive their chargeable income by deducting their total allowable expenses from their total sales. It is against the chargeable income that they then apply the income tax rates of Uganda to arrive at the taxes payable.
NB; In principle, income tax is paid against profits. If a business is operating in a loss position for a year of income (where its expenses outweigh its sales), such a business is not expected to pay income tax but it is expected to file a NIL tax return to URA for that period. Failure of this business to file a tax return will prompt URA to reach out in expectation of tax.
A business that is turning over more than Ugx 150 Million a year is also expected to register for VAT as a tax head and start making periodic VAT returns (month on month).
Additionally, If a business has employees who are earning more than Ugx 235,000/- a month, such a business is expected to file and pay Pay As You Earn on behalf of these employees.
Again, if such a business is consuming services from suppliers, then such a business is expected to deduct withholding tax (omusolo gwa nterekeraako) from its suppliers and remit the same to URA, but not to eat it.
So what is the picture of tax obligations for entertainers in the case of Uganda?
There are levels among entertainers.
There are the performing acts (singers, comedians, hypemen, deejays, etc) who are contracted to do a gig or contracted long-term to record labels or entertainment establishments. A musician given a gig to perform at Nyege Nyege in a one-off arrangement will part with a Withholding Tax deduction of 6% from his pay if he is a local artist or 15% if he comes from overseas. However, if the act is contracted to a record label and he is getting a monthly payment for his service to the label and he/she is paid more than Ugx 235,000/- a month, then PAYE is the expected tax payable by this artist.
We also have the category of bivulu promoters. This kivvulu can be a comedy show, a music concert, a play, etc.
The Kivvulu promoter as a withholding tax agent will deduct withholding tax from his suppliers (singers, band players, comedians, etc who grace his stage to perform for a fee. At this point, we must note that the tax is being paid by the performers and not the Kivvulu promoter. The WHT can be 6% or 15% depending on whether he is sourcing the act from Makindye or Tanzania.
The promoter is also expected to deduct VAT at a rate of 18% from every ticket sale for his/her kivvulu and remit the VAT to URA, not eat it. The VAT, while remitted by the promoter is paid by the concert or comedy show reveller (omukyakaze). If the promoter deducts the VAT but does not remit it to URA, then URA is obliged to come and fetch Ugandans' tax simububi. That is why URA deploys officers at events overtly or covertly to verify ticket sales.
If the promoter is running a full-time company with employees signed to long-term contracts paid more than Ugx 235,000/-, then that promoter must deduct PAYE from the employees' pay and remit the same to URA.
The beauty of Uganda's tax regime is in its self-assessment nature. At the end of the financial period, the promoter is expected to file his income tax and pay it to URA if at all they have operated in a profit position for that year of income. If they have not made a profit, still, they have an obligation to file a NIL return to URA indicating this state of affairs.
More often than not, tax disputes between URA and taxpayers arise from failure to file a tax return or simply put, a breakdown in communication.
In the spirit of #FfeBanno, we promise that our communication lines will always be open to every taxpayer and that every tax education opportunity is utilized.
We look forward to more partnerships to take the tax compliance gospel to every corridor in Uganda with the hope that if every Ugandan pays a little, then no one has to pay too much.

For sustainable recovery from fiscal challenges of widened deficits & increased public debt caused by #COVID19, Tax policies must be innovative to support Domestic Resource Mobilization. What alternatives can countries explore to increase revenue?
