Why Is Sharia Becoming a Midterm Campaign Issue? | Sophia Flores, One America News Network Voter concern about the prospect of a separate legal system with different rules on equality, free speech, and individual rights has prompted Republican candidates and lawmakers to take on Sharia in the 2026 midterms. A Washington Post analysis of Legiscan data shows that in 2025 and 2026 alone, 39 bills and resolutions were introduced at the state and federal level relating to Sharia, compared with 48 over the entire 14-year period from 2010 to 2024. Six of those measures passed in six states. This has been accompanied by public statements claiming that the classical tenets of Sharia are incompatible with the Constitution’s protections of equality. Rep. Chip Roy stated that “under Sharia law there is no freedom of speech, religion or women’s rights”. Rep. Keith Self said the initiative was being taken “to defend our Constitution, preserve our freedoms and make America a Sharia free nation”. Sen. Tommy Tuberville has said “Sharia Law is fundamentally anti-American and has no place in our country”. On 18th December 2025 Reps. Keith Self (TX) and Chip Roy (TX) launched the Sharia-Free America Caucus which has now grown to 70 members (Democrats have so far refused to join). The caucus supports the No Sharia Act (which would prohibit courts from enforcing any judgment, decree or arbitration award based on Sharia or foreign law which violates constitutional rights) and the Preserving a Sharia-Free America Act (which deals with related immigration issues). Sen. Tommy Tuberville is one of many others supporting this effort. Texas Governor Greg Abbott and Attorney General Ken Paxton have launched investigations into a Dallas area Islamic Tribunal which described its work as resolving family matters in accordance with Islamic principles. Outside Congress the https://t.co/QgkEQLAFz7 coalition (the Institute for the American Future under Frank Gaffney) has been doing education and mobilisation via their ‘Save Texas, Save America’ campaign. They’ve been promoting Texas Republican primary Proposition 10 (‘Texas should prohibit sharia law’) which got just under 2 million votes and passed 95-5. The coalition has produced briefings and short videos for mid-term voters. Private arbitration panels (Sharia courts) may be established under the Federal Arbitration Act if the parties agree to it in a written contract, but the awards are still subject to public policy and constitutional rights. Criminal matters and non-consensual proceedings are not within the scope of this. In November 2025 Abbott instructed the North Texas officials to look into the Islamic Tribunal and similar bodies. The Tribunal has stated that its guidance is voluntary and non-binding. Critics argue that community pressure and language barriers mean women cannot simply say no or raise an issue or seek legal advice elsewhere. The panels are almost invariably male and many have very limited written records and very little transparency. For a snapshot of where America may be heading, we can look to the UK. The 2018 UK independent Home Office review of the Sharia councils found that there was pressure on women seeking a religious divorce to come to some sort of arrangement with their husband (in the case of domestic violence this would be a particularly problematic situation). The vast majority of those using the councils were women who had no registered civil marriage and so had no statutory protection. The councils are panels of scholars (who are almost invariably male) and their decisions are of no legal force in UK law but carry much weight in Islamic communities. A September 20, 2026 Rasmussen Reports and Our Republic poll of 1,026 likely U.S. voters found that 43% of those 18–24 and 39% of those 25–29 held a positive view of Sharia, compared to just 16% of those 40 and over. Overall 21% were positive and 57% negative. Around a quarter of the under 30’s supported the idea of allowing Sharia to be the legal code of a community. The classical Sharia rulings are very different from the outcomes in the US: a son inherits twice the share of a daughter under Quran 4:11 whereas in US intestacy the children are treated equally; a husband can divorce by talaq alone whereas in the US both parties have equal rights and the divorce process is through the courts; a woman’s testimony is worth half that of a man in some of the classical schools of law whereas in the US courts treat all witnesses equally; polygyny is permitted for men only in classical law whereas polygamy is prohibited in the US; and classical hudud punishments such as amputation for theft have no counterpart in U.S. criminal law. Voters face a clear choice: whether classical Sharia’s unequal rules on sex, inheritance, divorce and testimony should be allowed to operate alongside the Constitution.
