Taxation of ULIP Gains - Gains from such ULIPs will be taxed as capital gains instead of regular income. Previously, under Section 10( 10D ) of the Income Tax Act, maturity proceeds from ULIPs were generally tax-exempt. 2021 Amendment & Threshold - In 2021, the government introduced a threshold: ULIPs issued on or after February 1, 2021, with annual premiums above ₹2.5 lakh, do not qualify for Section 10( 10D ) exemption. However, ambiguity remained on whether these gains should be classified as long-term capital gains ( LTCG ) or income from other sources. Capital Asset Classification - The Finance Bill 2025 now proposes to rationalize ULIP taxation - ULIPs not exempt under Section 10( 10 ) are classified as capital assets.
