The UPR is especially significant as it entails a complete review of a state's human rights record over the past 5 years, tackling a wide range of issues and producing strategic recommendations for the state under review.

ACTION CANADA - We welcome the recommendations made to Pakistan on protecting women's rights, the rights of transgender people, and sexual and reproductive rights. we are concerned by the recent aggressive ruling by the federal Shariat court which struck down key sections of the Transgender Persons Protections of Rights Act 2018. These provisions were deemed unIslamic and the ruling relied on the reductive hypothetical scenario that significantly present cis and trans women's rights as competing. We demand that Pakistan restore the protections in the Transgender Persons Protections of Rights Act 2018 without delay.
This ruling endangers transgender persons, activists, and allies and normalizes transphobia. #Pakistan must provide access to comprehensive sexual and reproductive health education and services including access to safe abortion for all without the requirement of spousal consent.

#UPRPak Rights of specific persons or groups (women, children, Persons with disabilities, Indigenous peoples and minorities, Lesbian, gay, bisexual, transgender and intersex persons, Migrants, refugees and asylum-seekers, Stateless persons) - A wide range of concerns were raised by numerous special procedure mandate holders, various treaty body committees and the UN country team regarding the need to improve access to fundamental rights, safeguards against discrimination, protections under the law and implementation of legislation concerning the rights of vulnerable and marginalised groups in Pakistan.
#UPRPak Various special procedure mandate holders stressed that it was critical that any reform to the investor-State dispute settlement system was consistent with the Guiding Principles on Business and Human Rights. The UN country team encouraged the Government to ensure the effective implementation of the National Action Plan on Business and Human Rights at the federal, provincial and local levels. The Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes urged Pakistan to expedite the ratification of the Amendment to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal.
#UPRPak Right to education - UNESCO recommended that #Pakistan ratify the Convention against Discrimination in Education and reformulate the provision of the Constitution to provide explicitly that education was a right for everyone within the territory. #CEDAW expressed concern that an estimated 22.8 million children aged between 5 and 16 were out of school, including 12.6 million girls, and recommended that Pakistan enact legislation and take measures to increase school enrolment among girls and reduce their dropout rate.
The United Nations country team recommended implementing the Constitutional right to free and compulsory education for all children, regardless of national identity.

#UPRPak Right to health - #CEDAW noted with concern the high maternal mortality rate, womenβs limited access to family planning services, restrictive abortion laws, the subjection of women with disabilities to forced sterilization, and the performance of gender reassignment surgery on intersex persons for legal gender recognition and victimsβ limited access to justice. The same Committee recommended that Pakistan ensure the implementation of the National Vision 2016β2025 for Coordinated Priority Actions to Address Challenges of Reproductive, Maternal, Newborn, Child, Adolescent Health and Nutrition. The same Committee, and the UN Country team, recommended that Pakistan improve access to health-care facilities.
#UPRPak Right to work & to just & favourable conditions of work - The UN team acknowledged that the govts. of Punjab, Sindh & KP had developed labour policies, & that the govt. of KP also had a child labour policy. It encouraged the effective implementation of those policies.
#UPRPak Prohibition of all forms of slavery, including trafficking in persons - #CEDAW noted with concern the high incidence of trafficking in women and girls for sexual exploitation and forced or bonded labour and the fact that Pakistan remained a country of origin, transit and destination for trafficking for the purpose of forced marriage. The same Committee recommended that Pakistan ensure the enforcement of the Prevention of Trafficking in Persons Act, 2018, and the Prevention of Smuggling of Migrants Act, 2018. The United Nations country team urged Pakistan to implement the Prevention of Trafficking in Persons Act, 2018, and establish a national referral mechanism.
#UPRPak Right to marriage and family life - #CEDAW remained concerned about the existence of multiple legal systems regarding marriage and family relations and noted delays in the adoption of a bill to amend the Christian Marriage Act and the Christian Divorce Act. The Committee recommended expediting the adoption of that bill and of the marriage bill for Sikhs. The United Nations country team encouraged Pakistan to ensure the implementation of the Hindu marriages bill, 2014, the Christian marriages amendment bill, 2014, and the Christian divorce amendment bill, 2014. The Committee recommended that Pakistan amend the Muslim Family Laws Ordinance and take measures to discourage and prohibit polygamy and ensure the protection of the economic rights of women in polygamous marriages.
#UPRPak Right to privacy - Several special procedure mandate holders highlighted the importance of examining the compatibility of the Citizen Protection (Against Online Harm) Rules with the obligations of Pakistan to respect, protect and fulfil the rights to freedom of opinion and expression and to privacy under international human rights law.
#UPRPak UNESCO recommended that #Pakistan amend existing laws such as the Prevention of Electronic Crimes Act, 2016, and the Citizen Protection (Against Online Harm) Rules, 2020, and continue to investigate cases of the killing of journalists. The Committee on the Elimination of Discrimination against Women expressed concern about reports that women human rights defenders were frequently subjected to reprisals, harassment and threats.
Three special rapporteurs provided information about alleged charges brought against a number of independent journalists and human rights defenders,
and the Human Rights Committee raised the issue of 75 persons being killed with impunity following allegations of blasphemy. Lastly, the UN country team urged Pakistan to act against violence against journalists and forced conversions.
#UPRPak Administration of justice, including impunity, and the rule of law - The Committee on the Elimination of Discrimination against Women expressed concern over the discrimination that may arise against women and girls as a result of formally recognising parallel legal systems and informal dispute resolution mechanisms in the Alternate Dispute Resolution Act 2017. It recommended that Pakistan ensure that parallel justice systems and informal dispute resolution mechanisms were consistent with the Convention on the Elimination of All Forms of Discrimination against Women and did not discriminate against women.
#UPRPak Human rights and counter-terrorism - Various special procedure mandate holders reiterated their concerns that the Anti-Terrorism Act and the #Pakistan Protection Ordinance seemed to allow forms of arbitrary detention conducive to the occurrence of prolonged incommunicado detention, torture, and enforced disappearances often resulting in the extrajudicial execution of the victim.
#UPRPak International humanitarian law - A number of special procedure mandate holders noted concerns about human rights violations in relation to humanitarian access, the collection of biometric data, Non-discrimination and the impact on women and children owing to their alleged association with terrorists.
#UPRPak Right to life, liberty and security of person, and freedom from torture. Issues were raised over the fourth UPR cycle (2017-22) by special procedure mandate holders, the UN country team and the Human Rights Committee on a range of issues relating to the right to life and torture, including arbitrary and summary executions, safeguards pertaining to fair trial and due process, the prohibition of torture and other cruel, inhuman or degrading treatment, the protection of the rights of juvenile offenders and the rights of prisoners.
