"it's a little hard for me to believe that the road to social justice is paved with more landlords"

should the less privileged always win?
no. they should always have a thumb on the scale, though.
uses by the large/famous may well be uses we want to encourage.
a little player's use is less likely to usurp the market of a big player than vice-versa.

fair use doctrine could better promote progress if it took into account things like party resources, power, & market share
why not add some context into our fair use factors?

it feels different when a teen makes marvel fanfic than it does when marvel makes a blockbuster out of a teen's fanfic.
the ideas of hidden hierarchies, how law enforces them, & punching up or punching down are relevant.

education, research, access to justice--benefit from fair use.
but it can also enable cultural appropriation & other badness
how we feel about this question has more to do with who's on which side of this equation.
@221Betsy #wipip2023
is fair use the answer to injustice in IP? is it a tool for social justice?
others argue fair use is often a means of exploitation
we're both right. but how do we make me more right?
@221Betsy #wipip2023
i'm thinking about social justice & copyright more and more
how do we put the fairness in copyright fair use?
@221Betsy #wipip2023
Consequentialist v. deontologist copyright throwdown at #wipip2023! Count me in the consequentialist camp. I admire the honesty of saying deontological copyright is about control, not money tho.
