The Province must acknowledge the devastation caused by its illegal actions and stop evading responsibility. This case also presents an opportunity for Premier Smith to demonstrate to Albertans that government overreach will not go unnoticed, and those harmed by it will be compensated—principles that align with the proposed amendments to the Alberta Bill of Rights. Alberta also fails to recognize the overwhelming financial, psychological and even tragic consequences its unlawful CMOH Orders had on Albertans. Many were left bankrupt, desperate for financial relief—relief which the Province is now using against them in its legal defense. Some business owners, unable to cope with the Province’s erratic decision- making—where businesses were shut down with no notice and then reopened unpredictably—tragically took their own lives. The chaos and fear created by the Province’s inconsistent orders wreaked havoc on Alberta’s families, businesses, and entrepreneurs. And now, instead of acknowledging its role in causing such devastation, the Province continues to deny and obfuscate the lasting damage it inflicted… 9. The public deserves better than a government that prioritizes its own interests over its citizens’ welfare, particularly when those citizens are seeking redress for harms directly linked to the Province’s own illegal executive orders. This class action, therefore, stands not only as an appropriate class action, but as a necessary mechanism for public accountability, which the Province’s Brief, in its current form, seems intent on undermining. 10. Moreover, the argument presented by the Province conveniently sidesteps the core issue of this case: that the Province’s illegal CMOH Orders led to significant financial losses for Alberta businesses, while disproportionately allocating $13 billion to public institutions compared to a mere $700 million for the private sector.
