The #ExploreAct was supported and passed by every member of Congress. Let that sink in.
This likely means it was either an act of legislative perfection, or something else is going on. There are some provisions that we like. It is also obvious that this bill hasn't been substantially changed since Chevron Deference was overturned. There are many provisions that are conveniently vague that would require agency discretion (which has been severely limited by the Chevron Deference reversal), or these provisions will require judicial interpretation. This means organizations like BlueRibbon Coalition will have to use resources resolving issues in this bill that could have been avoided if those drafting the legislation had aimed to fix root problems in our public land management system instead of writing something that could pass with 100% support. We can be assured that anti-access wilderness groups will be aggressively working to define the vague provisions in their favor.
We will take the few small wins in this bill, but it is frustrating that political capital was used to create new problems instead of decisively resolving long-standing problems.
