MAJOR INVESTIGATION NEEDED INTO DONEGAL TUSLA SERVICE AREA THAT HAS BEEN FOUND FOR THE SECOND TIME IN LESS THAN A YEAR TO HAVE FABRICATED FALSE ALLEGATIONS AGAINST A PARENT OF ABUSING THEIR CHILD…….that has come to light in the media. How many more similar cases have not been reported? 🧵 1/2 A Donegal mother accused by @tusla of sexually abusing her daughter has been found not guilty by a jury following a ten day trial. The background to the case is that the mother was a “a battered wife”. When her husband broke a barring order Tusla stepped in and took her two children into care, placed them in two separate houses and gave her one hour of supervised access weekly. This was supposed to be a short term measure to help her recover, but the children were never returned to her. Research by the Alliance of Birth Mothers Campaigning for Justice shows this is a very typical response by Tusla social workers to domestic violence. In 2018 allegations were made about one of the foster homes. It was then that the mother was accused of sexually abusing the child placed in this foster home when she was aged between three years and five years. The first trial began on January 23 and was into its fourth week when the jury was discharged by Judge Jonathan Dunphy at a special sitting of Letterkenny Circuit Court when it was found that Tusla files on allegations of abuse in the foster home was withheld from the jury. The Judge said he was presented with a ‘regrettable scenario’ where an issue was brought to his attention after the prosecution closed its case. Certain files were in the possession of either Tusla or other parties, which he said could have been ‘highly relevant’ to the case. “It now appears to go further in the possibility that they could lead to further information or queries that could go to the heart of the case, not least to the credibility of witnesses,” Judge Dunphy said. The second trial lasted ten days and ended last Thursday with the jury of seven men and four women unanimously finding the mother not guilty on all charges of sexual exploitation and sexual assault of her daughter. Major questions need to be answered about this case. Did the social workers deliberately concoct a story about the mother sexually abusing the child in order to cover up sexual abuse taking place in the foster home? This is the second case of false accusations being made against parents by social workers in Donegal to reach mainstream media within the last year. On Tuesday 12 December 2023 Mattie McGrath raised the case of William Porter who had false allegations of abuse made against him by Tusla social workers. “Yesterday morning, William Porter from County Donegal gave a harrowing account on Highland Radio of the false allegations made against him by Tusla social workers, and the devastating impact it had on his family and children. Tusla social workers falsely accused him of child abuse of his own children. Tusla has now given him an official apology, and of course after a High Court case the State must pay compensation,” Deputy McGrath said.
