The certification is open to a wide field of professions. Perhaps the guardrails are with those professions who are licensed in other professions. Seems everyone’s going to get involved in facilitating life estate planning documents. Is this a good thing? Time will tell.
In 2022, #NAHAC organized a task force to revise its code of ethics. It’s a small entity but plans to grow through its association and by certifying professions. Certification is a lucrative business. These entities thrive and grow by membership fees, exam fees, courses, continuing CEU’s, renewals and conferences.
Both the NAHAC entity and SDM legislation have taken root in the trend-setting state of #California. I haven’t read the SDM legislation yet - just noting the timing.
I read the code of ethics. My concern is when bad actors or those who give in to temptation, overstep boundaries to weasel their way into positions of power and control over others. I know too well how that sequence works. It’s a pattern.
As example, the often touted solution to qualify for Medicaid and SSI requires a “Special Needs Trusts” to protect one’s assets from clawback by the state - but the terms and the fiduciary can both become problematic especially when there are conflicts of interest. Or, Life planning documents coupled with a Living Trust to hold all one’s assets for protection but which in reality becomes under control of a third party. Sounds like an informal form of #Guardianship to me.
Redress? That’s handled in Family/probate /#conciliatorycourt and likely includes referral to mediation - if not guardianship itself.
The term “ Advocate” was chosen given the broad range of professions that the Association hopes to attract - and certify. Let’s take a look at its code of ethics and what the advocates are “empowered” to do (next post):
