The MoHUA letter dated 07.05.2026 and ORERA's representation No. 3188 dated 18.05.2026 both seek what I have argued for years: a regulator with real financial and administrative autonomy under the RE(R&D) Act, 2016. I support that. But as the Chief Secretary's meeting on 24.06.2026 approaches, one caution must be placed on record. 1⃣ Autonomy is a statutory question, not an executive one. Section 75 of the Act constitutes a single Real Estate Regulatory Fund, administered and spent under Section 75(3) by a committee of the Authority's own Members. Section 77 governs budget and accounts. Whatever autonomy is granted must flow through these provisions, not around them. 2⃣ The High Court has already spoken on this very Fund.
