Only after a second approval in that later session can it go to voters … with at least 90 days’ public notice after final passage. (it didn’t) 4. Ballot language must be clear and neutral. (it wasn’t) Democrats tried to fast-track it (via special session timing, early voting conflicts, and other shortcuts). The Court ruled they broke these rules, so the amendment was invalid from the start (“void ab initio”). It was their own law they violated.
