Such deprivation occurs when the stronger party exploits its unequal bargaining power to impose upon the weaker party disproportionate costs in accessing fair and meaningful dispute resolution.

CIPPIC intervened, recognizing that arbitration clauses can potentially serve as impediments to access to justice in a variety of contexts, such as consumer privacy claims and independent contractor labour. #UbervHeller
Uber claimed that driver contracts required addressing claims only in individual arbitration. The class argued, among other things, that the facts – cost, location, lack of availability of class arbitration, etc. - were prohibitive of arbitration. #UbervHeller
#UbervHeller deals with the effect of mandatory arbitration clauses in contracts on rights to bring class actions. This case involved Uber drivers seeking to join together in a class action against Uber claiming violation of Ontario’s Employment Standards Act.
